iPhone and O2 Freedom! need advice about where i stand legally!

I think the problem is that saving a website is not very secure in terms of evidence. Assuming you saved it as a file on your computer and not a screen shot (which could be photoshopped anyway)

Since I can edit a webpage quite easily using notepad.

And I think if you went down the legal route then that is what they will say.

I think that all this is a storm in a teacup - they made a mistake on their website, and corrected it as soon as they realised.

They should allow juzsp out of his contract as he was mislead into taking it because of this human error.

And they would gain some goodwill if they gave him something for his hassle.

However the O2 Freedom qualification specification (18 month pay monthly tariff with 600 minutes) does say that as an 18 Pay Monthly 600 minute tariff customer I am entitled to O2 Freedom

So with the iphone T&C's not saying i'm excluded from O2 freedom and the O2 freedom qualification specification saying that i am eligible, then surely i am?

And for that matter www.archive.org (although that will take up to 6 months to appear there) And in fact webpages have been used in court before! http://www.prnewsonline.com/legalpr/case_wayback.html

Also a simple review of their web update log will confirm when the page was updated.

Morally probably, but not legally.

They made a mistake, and have now corrected it.

If you took this all the way the most they would be ordered to do would be to reinstate you to the position you were in before taking the misleading (not deliberate, but due to an error) offer. (You hand back the phone, and they hand back the money you paid for it).

the freedom would not physically work with the iphone tariff anyway.
o2 set up the iphone tariffs in conjuntion with apple to allow all of the services of the iphone to work so if you got any other offer/tariff with the iphone you would not get complete use of all the functions on the iphone

You would also lose the unlimited Data package and WiFi access that you get with the Iphone tariff.
