Can PayPal legally get this back ?

    But this is exactly what isn't fair - yes, it's Paypal's policy, but the seller (OP) hasn't done anything wrong - Paypal are down on money due to the buyer (or fraudster that has gotten through Paypal's security).

    This is why I don't think they should be able to legally claim the money back from you - they should be chasing the person who charged the account and ran off.

    Of course, it's easier for them to chase you, but you fight, OP!!!
    i agree. its disgusting how they operate. i think in paypals eyes the buyer hasnt invested in paypal, theyve just paid using it, whereas you as the seller paid to receive said funds. And therefore u paid fee's to paypal to receive so they see it as ur their client... and their money maker...

    Exactly how i feel. I did nothing wrong (except trust a guy, who had plenty of good feedback on eBay), and instead of the guy responsible for this being chased, they slap me with the bill, and theres supposedly a policy that allows this :(.
  • My friend was caught out by this unauthorized account use thing and was harrassed by Paypal for the money but she went to the police and reported the fraud and was given a crime number. The debt collectors do not want to know now and have left her alone as it is a reported crime.

  • If it was a tenner or something I'd say just pay it and learn from the experience but its a lot of money to lose. You sent the item so you should receive the payment for it, if the buyer was fraudulent paypal should be chasing him NOT you. Why should you lose out on payment for your item due to paypal's incompetence? Paypal should take better care of its genuine buyers/sellers rather than usuing systems that are open to fraud then harrassing the innocent party because its too much trouble to chase the "bay guys".

    Personally, I'd do as another poster suggested and go to the police. If the debt gets passed onto a solicitor I'd be tempted to say "see you in court" - no sheriff/judge would rule that you have to pay paypal the money as you have been defrauded. Even if its in Paypal's T&C's that you have to pay back a negative balance that can be deemed to be an UNFAIR CONTRACT TERM.

    Phone PayPal to discuss the situation and if you don't get anywhere tell them that you be taking up the matter with the Financial Ombudsman Service : http://www.financial-ombudsman.org.uk/ Paypal doesn't like those 3 words.

    I thought id read somewhere that they dont actually have any control over PayPal, or something like that, so i thought not to bother :(.

    Would the police still accept this as a crime, even though i was frauded by someone in Romania ?

    FOS charge Paypal about £360 in investigate every complaint, and Paypal are still overseen by the FOS in the UK (even though they hide in Luxembourg).

    A crime is a crime. Fraud is a worldwide problem. They probably won't like it, as it adds to there numbers of reported crimes, but just insist on getting a crime number.

    Rang up the police today, gave them all the information and got a crime refernce number :) Time to lay the smackdown on the debt collectors :D.

    Its not a debt.

    Buyer has defrauded paypal, paypal can't be bothered to chase the buyer up, so try and get the money back from you.

    Paypal really should tighten up there procedures.
