Can PayPal legally get this back ?
Comments

Yeah they asked if it was valuable, i said yes, and they added a couple more quid to the cost for better insurance i think.0

Ogs,
I'd suggest that your item is gone and your unlikely to get it back. However I certain would not be refunding Paypal. Cancel your direct debit with them and tell them to sue you for it! (they won't).0 -
Not bothered about the item, or using PayPal again, i just dont want to have to pay those *multiple nasty words here* anything back. My only worry is that PayPal will have some legal ground to claim this back, which i hope they dont (How they can just reverse a payment like that, leaving the account in the negative, then go on to claim i owe it them by there actions.....just how ?).0

You owe paypal this money under the terms and conditions you signed up for..however how much they will chase you for it seems to depend sometimes.
Paypal just pass the debt on to a collection agency and there have been critiscms in the press of their strong arm tactics to get the debt recovered. We have had threads on here where sellers have felt bullied and intimidated by the debt collectors, yet other people have had nothing apart from a few phone calls. So yes they will persue you for the money you owe them, but how hard is anybody's guess.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. Shouldn't they be chasing the buyer for the debt??
Did the buyer actually submit an "item not received" claim and win, because it sounds like he just failed to pay..?
I can't see how this is your fault at all (legally and morally speaking, as opposed to "PayPal Land").Mortgage | £145,000Unsecured Debt | [strike]£7,000[/strike] £0 Lodgers | |0 -

Item must have been paid for otherwise buyer can't be reclaiming the money.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. Well, that was my initial thought, but the OP said "PayPal email me saying the owner of the account didnt make this payment,"
So, from that, it sounds like fraud against Paypal - not a buyer's claim..?Mortgage | £145,000Unsecured Debt | [strike]£7,000[/strike] £0 Lodgers | |0 -
Yeah, it wasnt a buyer's claim that they hadnt received it, instead it was an Unauthorized Use of his account thing claim. After i told the guy i sent it, i heard absolutlely nothing more from him

uve lost out. this is what happens with paypal: u send item trackable and buyer immediately cancels paypal d/d or changes to a dud bank acc, then paypal come back to you to recover the funds... while the buyer is laughing their head off with a free item. you have to pay it back as paypal are down on money and have no way of getting it from say a dud account of the buyer... so they return to the seller and put ur acc in a minus...
for this reason i dont use it.0 -

But this is exactly what isn't fair - yes, it's Paypal's policy, but the seller (OP) hasn't done anything wrong - Paypal are down on money due to the buyer (or fraudster that has gotten through Paypal's security).
This is why I don't think they should be able to legally claim the money back from you - they should be chasing the person who charged the account and ran off.
Of course, it's easier for them to chase you, but you fight, OP!!!Mortgage | £145,000Unsecured Debt | [strike]£7,000[/strike] £0 Lodgers | |0
