In all fairness Orange should have pointed out you would be locked into another 12 month contract (which includes the fact that you can't downgrade in the first 6 months).

However you should have read your contract (i.e. T&Cs). It is no excuse saying I didn't read the T&C's so I should not be bound by them.

Having been on three contracts with three different handsets in three different years, I guess I know that when I get an upgrade / new contract that there will be tie ins.

James, Were you trying to nab a free upgrade and extra minutes, as per martin's article, or were you trying to downgrade to a lower tarriff??

I'm thinking about going Orange Contract but I see their double talk/texts are ending today (30th June) so I'm not so keen till the next offer! Does anyone know if insurance is included in the monthly price for the 12 months?

Also is the phone yours to keep after 12 months? Any fee to pay?

The phone is yours to keep from day one.

Insurance, you have to pay extra. Its called Orange Care. Have a look on the Orange website for details. Also please, please, please read the terms and conditions, they are on the website.

    Hi Crazy chemist

i was phoned by orange offering a free upgrade in march, but no mention was made off the "tariff lock" for 6 months. I think with those double text that they are advertising that it locks u on for a new 12 month contract so i would definatley check

Orange upgrading terms and conditions: http://shop.orange.co.uk/shop/terms

    Upgrading

    Pay Monthly

1.Eligibility to upgrade your Orange phone is dependent upon the terms of your Service Plan, and shall include without limitation length of time since subscription to your Service Plan/last upgrade (if applicable).

    2. You must be up to date with your account payments to be eligible for an upgrade.

    3. No cash alternative is available and no credit will be given where an upgrade chosen is of a value less than any maximum value stated to apply.

    4. You will be responsible to pay the difference where cost of the upgrade is greater than any maximum value started to apply.

    5. If you upgrade your Orange phone, you will be bound to a further minimum term contract, with such minimum term as provided in your Service Plan.

    6. If you are not satisfied with the phone, you may return it within seven working days of delivery. Goods are to be returned in good condition and in their original box or with adequate protective packaging. Any accessories or additional products that were supplied with your phone as part of the purchase of that phone must also be returned.
This does not apply to accessories which you purchased in addition to the purchase of your phone regardless of whether they were delivered at the same time, which are subject to the provisions set out below. You must return the equipment along with the original invoice as proof of purchase and/or authorisation number. You are responsible for the return of the equipment until it is received by us, unless you have arranged for us to collect it, in which case you are responsible for it until it is collected by us. The equipment will be collected from you via courier at Orange's cost. In the event that you are not available at the time agreed with you for collection of the equipment, and we have to arrange another time to collect the equipment, you are responsible for the cost of return on this occasion (including our reasonable costs of collection whether we collect the equipment, which may be deducted from any refund due to you). Funds will be credited to the card used for the original purchase after receipt of the returned equipment and satisfactory inspection by us. Please allow 14 days for the refund to appear on your statement.

    7. Payment for your new phone must be made by credit or debit card. Any upgrade fee will be added to your Orange invoice.

    8. Your upgraded phone can be delivered to any location of your choice within the UK (excluding BFPO and PO Box addresses) and is subject to our Delivery Terms and Conditions.

    9. The Orange upgrade service is available to customers with an Orange Value Promise Service Plan with call charges matched to Virgin Mobile but phone prices will vary. Prices include VAT and are subject to change.

    10. If you have had your current phone for less than the minimum period specified in your Service Plan then you may be subject to an upgrade fee.

    11. Orange shall not be required to notify you at the time of eligibility for upgrade and you are responsible for ensuring that you take up the offer upon eligibility.

    12. Orange reserves the right to amend, vary or cancel the terms and conditions of this offer at any time.

See what clause 5 says. Took me two minutes to find on the Orange website. Also these terms were sent to you with your phone (they would have been in your Orange phone manual).

truscott_uk is there anything that can be done to stop this at all? Like with certain credit you need to sign a credit agreement form. Ore is it all legal and above board to say that u cant change it as youve upgraded as i do feel a bit hard done by on this................

They say that they upgraded me, but they've upgraded everyone to 2Mbps now anyway. In February I think I changed to Direct Debit (DD), but I contacted them for the upgrade and price reduction (saying I was going to change) back in November. I remember talking about it at Christmas.

That means that they've tied me into another contract when I changed to DD. I've rung them up again but they're not being too helpful. I'm going to take two tacks - 1) get them to change the contract to end in November, like I did agree to. 2) reduce the price NOW to the competitor's that I would change to if I wan't in a contract at all.
In fairness, option 1 is what it should be because I had agreed to that.

It's a separate to Orange, and I'm sorry for hijacking your thread!
