Witholding rent due to noise issues

the trick here is to work with your LL and ask him to complain to the relevent parties ie the noisy neighbours LL if they dont have one he can do it to the local council as so can you getting the right backing from your LL in this situation is really helpfull for your case0

Usually i'm a landlord basher but here i don't really see what your complaint against him/her is. Even if he is the landlord also of the tenants above he has no control over their behaviour and can't ask them to be quiet!! All he can do is serve them notice but then that will take time and isn't really in his interests and certainly he is under no obligation.
I know how annoying it can be to have noisy neighbours so you have my sympathy but withholding your rent is the wrong way to go, you will end up evicted and being pursued through the courts for unpaid rent! Just thank your lucky stars you are renting and haven't bought the flat, then move out at the end of your tenancy.
When you give notice to your landlord let him know the reason you are moving out and he may be more inclined to find a new tenant for the upstairs flat!!0 -
I work fo a Managing Agents - do not withhold your rent its a sure fire way to get yourself evicted.
Do you have a Managing Agent or does the Landlord manage the properties himself? The key is to work with either & if it cant be resolved move on. In the end he will be left with problem tenants & an empty flat so it is in his bestr interests to help.
Your neighbours are in breach of their tenancy as they should not make living conditions unpleasant for others. My place had a similar problem with dreadful tenants upsetting other flat residents (ie jumping out of windows coz too lazy to use stairs?!!) & the tenancy was terminated with a Section 8 Notice which was served about 6 weeks after they took up residence.

Can't you arrange for your upstairs neighbour to invite the downstairs neighbour up for coffee & accidentally drop them out the window with a noose round their stupid neck?
I'm kidding of course, don't withhold rent but keep complaining to your landlord & get the Environmental Health department from your local council involved as well.Winnings

I'd have a word with the LL - if you're a good tenant then (s)he'll want to keep you and so may do something about your neighbours.
Sadly though it is a case of caveat emptor (or I suppose caveat rentor).

Thanks for replies. Meeting is due later today. Noise situation much better. Probably behaving themeselves for a while because of the meeting. Expecting the meeting not to achieve much but hoping for the best. Fairly resigned to getting out as quick as possible. Letting agents have verbally agreed we can go before end of tenancy if situation does not improve0

hello all . meeting did not achieve much and noise is back to old levels. other tenants broken several other agreements too. Mrs Chip has spoken to letting agent and again been given verbal agreement to leave early but nothing in writing. any advice? i think we are being strung along by the LA and we will not be able to shorten the agreement with nothing in writing it would be our word v theirs0

Environmental health is the only body to sort this. start to keep a "noise diary" and get everyone else to do the same.0

I do so sympathise with your situation, it is utterly miserable living with inconsiderate neighbours. It doesn't matter how tolerant you try to be, constant annoyance like this wears you down. Life is too short, if you can't relax in your own home then it can impact on your work and relationships. In my experience it is easier to move (and avoid flats with tenants above you) than to change the behaviour of those who don't give a toss. You'll find nobody involved in this case cares about your concerns anyway.0
