You should have got a booklet on how to appeal with the letter stating incapacity had stopped. You need to contact a citizens advice bureau or a local welfare rights org. to help you complete an appeal form. Don't attempt an appeal on your own.

Hello im also new to all of this,let me start by saying i have been on Incap for 6 years.I filled in a questionare a few months ago from them and recently got a phone call to attend my medical.I was told i would recive a letter to remind me but that never came.So i went for my medical and just recived letter sayin i failed.Now i got 12 points but needed 15 to pass,but it seems some of the answers i gave, the Doctor has put the opposite down.For example as i cant sleep and get medication for this i said this affects my daily activities,but they have put down that it doesnt.
Now i am thinking of appealing against this decision,but didnt get any leaflets to advise me on how to appeal.Do i have to fill out more forms with help from a Welfare Rights person,and will this person help me when i have to go to the appeal meeting?Ive never done appeal before so this all new to me.0 -

In fact atos carry out medicals not make the decisions so if they getting the blame for bad decisions perhaps decision makers should start having medical qualifications and stop simply rubber stamping atos origin medicals.0 -

But the decision maker makes his or her decision based on what the dr from atos has put!! and in my case(and many others on here and elsewhere) made up most of the stuff and twisted wot i said so in fact they are responsible for a majority of the failures.:mad:0 -
donnalove then thats a problem with the system, the DM should also be using evidence provided by the claimant (rather than always brushing it aside and using atos reports only) and evidence from other medical proffessionals such as GPs and specialists. Obviously atos do make mistakes the doctors used are similiar to GPs in skillsets and have never met the patients before so have to make judgements based on a very short one off medical but noone is pointing a gun to a DM head saying you must only use atos provided evidence.0

keith I cant speak for everyone but I expect people can and do get depressed whilst employed. The advice I hear people say most often is get a job and depression is healed. Probably the worst advice I have heard, not because I think it won't help as it may well do but because the people saying it typically think depression is a simple illness.0

Perhaps you could go away and learn about clinical depression, and then come back and give an informed opinion?
Would you have the same point of view about somebody with diabetes? Both are caused by chemical imbalances.Gone ... or have I?0 -

I can think of various reasons why depression is on the up, living today is so more stressful than previous decades.0
