Appealing against Incapacity Benefit ceasing

    The govt fund Jobcentre Plus to give advice to those who need it, either in person, by phone or (in some cases) by email. The govt website www.direct.gov.uk is also designed as a source of information on benefits.

  • I have been on Incapacity Benefit since mid 2003, I was working and had to be signed off due to anxiety and despression from January 2003, I eventually had to resign from my job as my condition remained the same, plus the severity of the panic attacks I experience meant that I couldn't go to work.

    Every couple of years or so i have been called up for a medical, and each time I have been allocated sufficient points to remain on IB, i have had appointments with the IB dept at the Jobcentre on a few occassions (the last one was Christmas last year) and each time I have been told that I am too sick to work.

    So imagine my surprise after my last "medical" in June of this year when I got a letter several weeks down the line saying that me IB has been stopped due to insufficient points! When I read through the report I was horrified to see that the examiner had completely fabricated the report, he scored me 5 points but I made it 22 in total!

    I am now in the process of appealing against this, which I am finding extremely daunting as I don't see why I should have to appeal against something because the examiner wote down the wrong answers! Its unbelievable.

    I am now at my lowest ebb, visiting the Psychiatric unit for mixed anxiety and depression, having to rely on my Mother to take me to the shops as I can't go out on my own, and feeling very, very down.

    Its hard enough to cope with my illness, and to have to go through all this is just too much to cope with.

    So at the moment I am left in limbo, I haven't had any money for about 6 weeks now, can't claim Income Support because my husband works, and can't claim Jobseekers Allowance because I am unfit for work.

    Surely they would have taken into consideration all of my other medicals and interviews and wondered how this latest one differed so much? But no, they just cut my money and leave me stranded.

    Has anyone on here appealed successfully and if so, how long did it take?

    An appeal is usually heard after three to six months depending on how busy they are. 50-60% of appeals are successful when the appellant attends.
