You don't know that it was human error. Like I said, it might have been sharp practice to sell another sofa. This kind of thing goes on in certain industries where people are trying to meet sales targets etc.
If any company was stupid enough to send me an item worth hundreds of pounds without me asking for it, I'd have absolutely no sympathy for them, and I'd use the law to my full advantage.
A fundamental part of the Unsolicited Goods Act is that it applies to circumstances where a Company demands payment for unsolicited goods or services supplied. The Company is this case has realised an error and is simply asking for its property back, not asking for payment. If as you suggest it was sharp practice and they were trying to sell another sofa why were they not asking for payment? What I do see as wrong is that the OP was happy to accept the goods thinking that they would get away without paying for them. You're either honest or you're not.0 -
I totally agree with the other posters - how could you NOT know you had to ring them...? Did your mate not have to sign something - surely the deliverers (?) would have had a named person to sign and when it did not match they didnt query it...?
God, when you got in did you not think hang on I never ordered a sofa - its a sofa for gods sake - did you not have to get rid of the one you had to get it IN your living room. I cannot picture how this could have innocently happened.
You are worried about them taking you to court and you getting into trouble and rightly so. You have tried it on and been caught and it serves you right. You wouldnt be even asking this question on here if they hadnt been in touch ans scared you.
Yes, some poor s*d somewhere is waiting for his sofa and they will have it recorded as delivered.0 -
