Hi evryone
Have just joined and wondered if anyone can give me some advice. I recently seperated from my husband(Jan 08 ,second marriage)the house we are in is rented from my first husband whom I divorced in 2001, my 14yr old DS from my first marriage lives with me. My X purchased this house after our divorce so I have not had anything to do with the property before renting from him with my current husband. I am disabled and have been on incap/disabilityLA for many years due to Rheumatoid Arthritus, plus many other illnesses that run along side of this complaint. Since my husband left I have not been able to pay my rent so after getting advice from CAB applied for HB / CTB and IS.
I have been refused HB and IS. The IS say I have £5 awk too much, the HB turned me down on the grounds that my son lives with me and government regs state that you cant claim HB ' if you rent from a close relative ' . I appealed against this as my DS does not rent from my X , I do but am still waiting to hear, have tried several times to speak to the lady who deals with appeals but she is never available. My Husband and I have been on the LA housing list for 2yrs+ and now I have to apply in my own name but they will back date it to when we first applied. Can anyone offer any advice of what to do next because if I cant get help then we will end up homeless. Thanks0 -

Good evening everyone, Ah, bummer about the Euromillions Hol!! I had a party planned and everything, LOL!!
A little bit of news, got a response from my MP today, he will be happy to speak to us next Saturday and in the meantime he is writing to the council to find out what the situation is. So all positive as far as I can se as they could have told us their appointment book was full, or fobbed us off with a meeting instead of asking the council what as going on in the meantime.
So, until I get something negative I am taking this all as positive. I feel quite happy at the moment and I am sleeping well so that is a bonus!! They are probably going to be sick of me by the time comes, LOL!!
Still filling in those DLA forms, you get a bit of the way through wondering if you should have filled in that bit but Ifigured they can always disregard it if I should not have done. Copying everything as there is so much info on there I am sure it will be easy to forget what is in the lsit. Everyday I remember things that should have gone on a certain page so I am sending it off in the last week before it is due to make sure I say all I need to.0 -

Two things ref the DLA forms. 1) Don't put a positive spin on it. You have to tell the unvarnished truth about your son. Put how he is on the worst of days. Reason being that I have seen people on here been refused because they have not been REALLY honest about how bad their problem in. I am NOT suggesting you lie, but telly it like it is
2) When you have finished filling in the form, take it to the CAB and they will check it over for you to make sure you have filled it in right. Apparently the people who give out DLA are VERY picky, and if the form isn't right might reject it.
good luck with all of this

ps your BIL sounds like a right !!!!!!!I want a job that is less than an hour driving away from my house! Are you listening universe?

Hello Blue_Monkey,
I am just reading through your thread, do you know about the site Barton Hill Advice Service? it has a PDF download which may help you fill out Ryan's DLA form.
http://www.bhas.org.uk/freeguides/dla_guides.shtml
this is the address ( my brain is not working to send you the link today, sorry )
Take your time filling out the form, and remember to mention Ryan's WORST days as well as his best days.Today, my BEST is good enough.0 -
Hi everyone,
I changed the title of the thread. The date has finally arrived, Weds 2nd April at 12.30pm, so 6 weeks tomorrow. I called the court and have asked if I can send a letter instead of appearing and explained about Ryan and they said it should be fine and the eviction date will be done in our absence. Apparently we are a 'rare' case as people usually contest at eviction hearings, and he said to me 'but you don;t want to be evicted do you?' I said we did not have any choice really as I could hardly tell my mother not to sell her house, could I? And he said no, your case is unusual, but the date will be given in your absence, just fill the forms in. It is half term and I don;t have anyone to look after the kids so it'll have to be that way.
I then called the council (as they had told me to do) who told me to let them know after we had been to court. i said and then what? They said the homeless side will deal with me. And then I just said 'but then what, why does no-one tell us anything, what if we get given 14 days to leave, by the time we get the letter it'll only be a week's notice, how can you help us in that time?'. She went off and came back and said that there was nothing available to suit us at the moment but we had to speak to the homeless department after we had been to court and that the court could allow 6 weeks. i said shall I ask them that, tell them that you told me that, and she said 'no, as I am not sure if that is how it works'.
Why was I explecting anything else. I believe it'll be dragged out until a few days before we have to leave but I am going to write in the notes and letter for the court why we cannot leave.
Still nothing available in this area or anyone that will have us.
What worries me more is the schooling side of things, will I have to put the kids in a school for the time we are in a hostel and then move then again when we get housed? I really do not think i can afford to do 60 miles a day to get the kids to and from the school they are at now. I am OK about things, me I don't really care, but it is the kids I am worried about, the disruption, knowing how hard they are going to be in settling only to be moved again and I have had so many problems on the schooling side. Ignore me though, PMT so having a rant!! It helps
I have my meeting on Saturday with my MP so let's see what he has to say I suppose and go from there. I have information that someone PM'd me so going to start getting that together now as well. Another day.
Kind of weird opening the letter, although I've been expecting it to see the stamps and it saying courts and that I felt very sick and shaky.
Someone who had a viewing on Saturday wants to come back on Thursday to see the house again so he is interested. What a shame, LOL!!
Oh, and why does all the important stuff happen when yo have PMT so it feels 100 times worse than it actually is??0 -
Christabell, I just saw your message, sorry. I have been using a form from cerebra to help fill the forms in. I am almost done, spent 5 hours on it so far but have to keep on picking it up and putting it down as some bits are quite hard to fill in and very draining emotionally. I have until Mid March so making sure I get in all I need to say.0
