HELP...Re Ernest Jones

Hello, am new to this so i will be brief. I need some help. My fiancee wanted an omega watch and they are usually super expensive ,however last oct went to ernest jones where the price had been dropped to less than half price. They didnt have any in stock so they said they would order it but it takes 90 days so he had to put a deposit down and the till reciept said it would be ready for feb 5th. Now they have said they cannot get the watch it is discontinued but they can get it direct from the omega store, that he should have his deposit back and if he wanted it then he would have to pay the full price. It was supposed to be my wedding day present for him. They now are not responding to recent emails. How does that work???? They took the deposit etc. Can anyone suggest anything am fed up with these big companies they rip everyone off given the chance. They still have our deposit as i am pushing the matter because i feel so cross about it..

You have the right to your deposit back
They cant supply a product they cant obtain
As far as I can see your not losing out here as such and dont have a claim beyond the deposit0 -

The problem is i want the watch so do you think if i keep persuing it they will get it sorted. At the moment they have the deposit which they have offered back but as a matter of principle surely they should provide the item you have paid a deposit for... is it against shoppers law or something.

Do you expect them to magic it up?
Its been discontinued, they cant get one

A watch? well buy a different one or get the deposit back and buy direct

Well. I wouldn't put it quite as abrasively as Iamthe smartest.., but I think he is very probably right. Where a product is discontinued I doubt they have an obligation to find one for you. I agree it is a pretty poor show from Ernest Jones - especially as it has taken a long time to tell you.
I have had this quite a lot when buying CD's, DVD'd, etc. - they say they are 'on order' then months later you get an email cancelling the order. Usually, they don't take the money until dispatch, though on occasion it has been taken and then refunded.
I assume you have asked them to ring other branches to see if one is still in stock somewhere, or maybe they would be prepared to let you have a different watch at a discounted price.
Even if you don't get your watch, at least you have warned others who may want to buy in similar circumstances. If you post on the "I Wanna.." thread, someone may be able to locate the watch for you. Good luck.0 -
I would have thought that a contract was formed as they took a deposit - if it were the other way round and they had got the watch and then you decided not to want it they could force you to continue with the purchase (or chase you for the full price through the courts) and so I can't see why you could not do the same.
There is also "Loss of bargain" that might be worth googling for.0 -
thanks everyone, ernest jones said that they have discontinued the watch, but if i still wanted it then they could order it from omega direct as they have not discontinued it, but i would have to pay ernst jones the full price for getting it in. I just think its a bit of a swizz and more importantly it was a wedding pressie for my hubby to be so will have to admit defeat. bit rubbish though.0

I think I would argue the point, they did sell it at the time you ordered, you paid a deposit for that item, it is still being made so there is no reason why they could not supply. I would be tempted to send them a letter informing them they had 14 days to fulfil the contract/order or I would take them to the SCC.0

Can you give us details of the watch, and a max price you want to pay?

Thanks for your help, the watch originally in the omega store is £1800 its a black face titanium seamaster code 2231.50.00 however in ernest jones is was a bargain of £880 hence the reason we went straight in there to get it. they said put a deposit down and it would be instore for feb 5th and that is what is says on the reciept. I am just really cross with them,but i figure if i dont go in and get my deposit back then i can still fight on because if i do get the deposit back i havent got a leg to stand on and the deposit was for about £200. can i just ask what is the scc, sorry am new to all this but thought it was a good forum to discuss it in. Any ideas... and also they are ignoring my emails now. i will write a letter and send it to the MD what do you think

SCC=Small Claims Court. If you have it written down that they were to supply by 5th Feb then I would think you have a very good case. It was not mis-priced so can't see how they can get out of it. But I am no lawyer. But would still think it was worth the £50-70ish it would cost to take them through the SCC. Go to https://www.moneyclaimonline.gov.uk to start the ball rolling.0
