Brken Phone

Evening all.
My girlfriend is presently 15 months into an 18 month contract on the Orange network. Its one of those LG Chocolate phones, and it has recently started playing up. About 75% of the connections made from dialled or received calls – she is unable to hear anything the other person says. She has looked after the phone well, and I would consider the problem she is experiencing a product defect – rather than something brought about by misuse.
The warranty on this phone is only for 12 months, so essentially there a six month period where you are committed to paying for a service that you potentially cannot use, should something happen to your phone completely outside of your control.
This doesn’t seem right to me. If the phone does not last the 18 months, then surely it “isnt fit for purpose’’?? You wouldn’t commit to a Sky contract if you knew that the dish would fall apart after month 9 (without a free repair).
Anyway – the reason for my post; is there anything we can do about this?? Orange will not repair or replace. They have suggested that we return to the shop from which it was purchased. The gf is reluctant to do this, as she feels she will be fobbed off because the warranty has expired (and is a bit resentful as she was pressure sold it in the first place).
Thanks in advance.

I was under the impression that when you take out a contract they phone is classed as seperate to your package ( line rental and calls. etc.)
so the phone would not be guarenteed to last for an 18 month contract.
Some one else might shed some light on this.

Lamb is probably right.
But the Sale of Goods Act says something along the lines of...
The goods purchased must last a reasonable amout of time. (My words).
Is 15 months a reasonable length of time for a mobile phone to last? I think not. Complain to the seller. Ask the seller to repair or replace your phone.
Googling Sale of Goods Act will give you loads of information.0 -

Have you tried contacting LG directly.
The last time I had a LG phone it had a 2 yr warranty. They took all my details and arranged for me to take it to my local Carphone Warehouse for repair. Took about a week to get done but CPH can supply a loan phone whilst its with them.
Its always worth contacting LG or a mobile repair place. May not be as exspensive to get fixed as you think and warranties are always supplied by the manufacturer not the phone network.Lightbulb moment: August 2007. Debts totalling £15,634.
