Have just called my local store in Crawley and told them i had recieved it but its evidently preowned - they were great and told me to bring it in tomorrow with my invoice and they will replace it with a new one.
They have put one aside for me :T0 -
You could buy it brand new for £4.99 + £1 P&P or you could buy it pre-owned for £1.99 with any other xbox 360 game over a fiver.
I'd have bought something else and the pre-owned copy if I'd known.
The pre-owned was something like £11.99 not £1.99. (Could have been £7.99). But it was certainly more expensive to buy a pre-owned than the £4.99 NEW version. I had a chuckle about the crazy price to a workm8 when I ordered mine.
Mine also arrived today. Not sealed and cover is full of surface scratches and a mark where a sticker has been. Also if you hold it upto the light, you can see some numbers indented in the plastic as if it's been used as a rest when someone has written something on a sheet of paper. Looks a bit like a CC number  but not the full number.
The games disc is brand new, with no marks whatsoever on it.
I phoned them and had a moan, they said that some copies that were sent out, their covers may have been on the store shelves, but the games discs are new. She said I could return it for a sealed copy if I wasn't happy - I'm not, but it's hardly worth the effort for a £4.99 game. So just voiced my disapointment and said I would take this experience into consideration when I purchase my next game.0 -

to be honest i cant see anyone selling them on ebay at that price, its hardley a new release game and you can buy it brand new if you look around other websites for abot 14 quid so there would be very little profit in it by the time you be fees and the like, imo i think everyone that bought one was more than likley a genuine buyer and not a reseller0 -
Got mine today game was fully sealed and nowhere on my invoice did it state game as NEW. As long as it works my son is not bothered anyway so Im happy.0

Complained to Gamestation that it didn't look new. Got a reply yesterday stating that the disks and instructions were new, but cases had been taken off shelves from shops. Disk and instructions are in 'as new' condition so could be true. Is this normal when buying in a Gamestation shop i.e. you get the case that's been on the shelf? Unfortunately this means cases are often a bit tatty looking. This would certainly put me off buying anything from their stores (unless a real bargain).0

Well, I haven't got mine yet. Ordered over the 'phone - but when the invoice email came through it said 'Spiderman 3 the Movie'. Can't get through on the 'phone, but if I get a dvd I will be very cheesed off. Mine was for a nephew's birthday present, so I will also be annoyed if it's 'pre-owned' or knackered as well.
I should have know better than to get stuff from Gamestation - I have had stuff before that has arrived in battered boxes (played ok) and certainly looked used. Must remember to avoid them when it's a gift for someone else.0 -

I took my 2 copies in to my local branch but they wouldn't swap them for sealed versions as they said the shops and the internet were separate and they weren't allowed. They were nice enough and agreed that my copies were in poor condition and rang CS for me. I spoke to the lady on the phone and she said I could return them for a swap although I wouldn't be guaranteed sealed copies.
Not sure what to do now. They were intended as presents but they look a right state.

I wonder what trading standards would thin, as these games were advertised as NEW...I Hate Jobsworths!!!0
