MIF while on LCWRA

just wondering if this is normal. Long story short. Was working 2 jobs self employed window cleaning morning employed cleaner afternoon. Had a bad stroke lost all right side. One year later employer stopped sick pay so I resigned as wasn’t sure I’d ever be capable to go back. Regarding my SE I got someone working it kept texting customers who pay me and I pay him I declare all this each month. When I stopped employment I had to say update in circumstances so clicked self employed then got an appointment saying review to discuss MIF im concerned if this is put in place I won’t get any UC and won’t be able to work due to my stroke and be up !!!!!! creak

If someone else is doing the window cleaning for you because you are unable to do this due to your health, I would think that you are not considered to be self employed, you are instead not working due to illness and would be eligible to apply for sickness benefit (ESA/PIP/both).

If you have LCWRA you cannot be found to be gainfully self-employed and the MIF cannot be imposed.

yes it’s been confusing there’s still maybe £500 a month going through my account and I take a £100 for my troubles. I hope and pray one day to return to it this was my goal now 18 months on its looking less likely. I was thinking long term perhaps I could find jobs on line and take a cut. I really struggle with having no aspirations I’m only 38!

Sorry to hear about your stroke.

Regarding your self employment for UC, you are still considered self employed, and will need to declare your income and expenses into and out of the business each month. Whilst you are unfit, and someone else is doing the work, you are effectively 'employing' them through your business, so you should declare what you pass on to them as an expense. For example, say customers pay the window cleaning business £1000 in the month for having their windows cleaned, and you pay the person doing the work £800, then you have £1000 of income into the business, £800 of expenses (wages out), leaving £200 profit which is your income.

Because you get LCWRA, you cannot be considered gainfully self-employed, so the MIF cannot be applied. They should have removed the MIF once you were awarded LCWRA - this may be why you have an appointment to review your MIF, or just to go through everything else with you so you are clear what you are doing. But do not worry about the MIF as this cannot apply to anyone with LCWRA.

Are you the fbi 😂 it wouldn’t have been the exact sane thing? I’ve had no contact from the job centre since got my LCWRA awarded then my sick pay from employer ended so changed my circumstances then got a journal appointment so was wandering why.

it’s a real blag I think if you earn less than 3000£ you don’t have to register with HMRC but I need to be registered with HMRC to be self employed on UC. Last year I just put 3000£ through even though was less just to keep it going. I do wonder why I bother because it’s more hassle than it’s worth but I’ve not really much going on as sad as it seems still gives me some sort of purpose

Anyone with self employed income before expenses of more than £1000 in a tax year is required to register with HMRC for self assessment as a sole trader. As this is not optional, UC will expect anyone who is self employed to have done this, and will ask for your UTR number.
