Judgment Order - Help!
Hello - I need some help with a judgment order my Dad has received. Civil Enforcement were claiming for a violation dated 10/05/2023. I did the initial appeals for this particular claim and then a Claim Form was sent in early Sept. My Dad initially showed me the form and I was going to respond to it, but never got around to it. Now he has received judgment order from HM Courts & Tribunals Service. It does say you can apply for it to be cancelled but have may have to pay £321 court cost and attend a hearing (both of which I do not want to do!). Can someone please advise, what are my option here?

You have to have a valid reason for a set aside. Not getting round to it isn’t one of them.

Options appear to be
- Pay it
- Don't pay it
- Apply for setaside
If you choose option 3, the mechanism is set out in the Newbies thread. Remission of the fee is possible if the defendant is on a low income. The defendant is not always given a hearing but should be willing to attend if that is ordered.

Thank you for this information. Can I attend the hearing on behalf of the defendant ?
Also, if you don't pay it, does it mean bailiffs will come round to the house?0 -
if you don’t pay a CCJ, yes bailiffs may well come round and your dad’s credit history will be thoroughly trashed. Impacting on his ability to get in the future.

No, you aren't qualified , the defendant must attend or pay a qualified person like a solicitor
Not if its less than £600

Why hasn't anyone mentioned the free alternative CCJ help offered by pm?
What's the judgment date?
Was the claim in-house from CEL or was it a DCB Legal claim for CEL?

You can accompany the defendant in the unlikely event of a hearing. Whether you are allowed to speak would depend on the judge.
No, bailiffs are unlikely on a sub-£600 debt as they would have to use the court bailiff who is not very effective. It's not impossible but the non-court bailiffs tend to get used on council tax and magistrate court fines

Or perhaps they can be assisted to remove the CCJ another way. By consent.
But I need answers to my questions first.
