  • NTO draft appeal

    Dear Euro Car Parks,

I am the registered keeper of the vehicle and I am appealing this Parking Charge Notice.

I dispute the charge and do not accept that the amount claimed is owed.

The alleged contravention is “Vehicle was parked outside of advertised parking hours”. I dispute that the relevant parking terms were adequately communicated through clear, prominent and legible signage at the site.

The main signage prominently advertises “3 hours free parking”, whereas the overnight restriction and requirement for gym users to register their vehicle details are presented in smaller wording. The legibility and visibility of these terms in the hours of darkness, and the positioning of the registration instructions inside the gym rather than at the car park entrance, require proper consideration.

This document is headed “Notice to Owner”. As this is a private parking charge, please clarify the legal basis and purpose of that notice and confirm whether Euro Car Parks seeks to hold the registered keeper liable under Schedule 4 of the Protection of Freedoms Act 2012. Please explain how the notice complies with the applicable statutory requirements.

Please assess this appeal and cancel the charge. If you reject it, please provide the full reasons for rejection, the evidence relied upon, and a valid POPLA verification code.

This appeal is made by the registered keeper. I am not providing the driver's identity.

They will probably reject all appeals but you will see better success at POPLA especially with the NTOs.

No you need to make the NTO ones much shorter and threaten the BPA and CMA.

  • I am the registered keeper and dispute this charge in full.

Your notice is headed “Notice to Owner”, terminology ordinarily associated with statutory parking enforcement. Please clarify the legal basis for this notice and whether you contend that keeper liability has been established under Schedule 4 of the Protection of Freedoms Act 2012.

The signage and the prominence and legibility of the parking terms are also disputed.

If you reject this appeal, provide your full reasons and a POPLA verification code. I reserve the right to refer any substantiated concerns about your signage, notices or compliance with applicable industry requirements to the BPA and, where appropriate, the CMA.

The driver's identity is not being provided.

Remove this as it isn't relevant:

"and whether you contend that keeper liability has been established under Schedule 4 of the Protection of Freedoms Act 2012."

    Change this;

…compliance with applicable industry requirements to the BPA and, where appropriate, the CMA.

    to

compliance with applicable industry requirements to the BPA and - regardless of outcome - I will be sending this evidence of impersonating local authority NTOs to the CMA.
