Eurocar Park PCN
Hi all
It's been a while.
I would appreciate advice on six Parking Charge Notices from Euro Car Parks (ECP) relating to the Morrisons Sheldon car park in Birmingham, which is also used by The Gym Group.
I am the registered keeper of the vehicle. I have not appealed any of the notices yet and want to make sure I handle them correctly without identifying the driver.
All six allege the same contravention: “Vehicle was parked outside of advertised parking hours”.
Date of event| Entry time| Exit time| Date issued| Notice heading
22/09/2026| 05:49| 07:19| 30/09/2026| Notice to keeper
23/09/2026| 05:35| 07:17| 03/10/2026| Notice to Keeper
24/09/2026| 05:40| 07:12| 10/10/2026| Notice to Owner
28/09/2026| 05:48| 07:16| 14/10/2026| Notice to Owner
29/09/2026| 05:40| 07:09| 16/10/2026| Notice to Owner
05/10/2026| 05:34| 07:15| 17/10/2026| Notice to Keeper
Each recorded stay was approximately 90–101 minutes. ECP is demanding £100 per notice, making £600 in total.
The car park is shared with The Gym Group, which operates 24 hours a day.
The main car park sign prominently advertises “3 hours free parking” and says the maximum stay is three hours between 06:00 and 23:00. It also states that parking is prohibited between 23:00 and 06:00, except for gym users who must register their vehicle registration number at a console inside the gym.
There is also an A-frame sign inside the gym explaining that registration is required for gym use between 23:00 and 06:00, or for stays exceeding three hours.
My concern is that the overnight restriction and registration condition are much less prominent than the large “3 hours free parking” wording. The relevant small print is difficult to read from a distance, particularly in darkness. The registration instructions are inside the gym rather than clearly communicated at the car park entrance.
The vehicle was recorded entering before 06:00 and leaving after 07:00 on each occasion. The stays were all under two hours.
I understand that the signs do mention the registration requirement, so I am not claiming that the condition is entirely absent. My concern is whether the terms were sufficiently prominent, visible and readable to be adequately communicated to drivers.
Should I submit six separate appeals using the same core wording, or is there a better strategy because the notices relate to repeated visits to the same site?
Some notices are headed “Notice to Keeper” and others “Notice to Owner”. Does this distinction matter for private parking charges, and should I check each notice against the requirements of Schedule 4 of the Protection of Freedoms Act 2012?
What specific wording, dates or other details should I check on each notice when considering whether ECP can pursue the registered keeper?
I have been to the gym group manager about the first two notices but as of yet nothing has been done about it.
Thank you.

POFA requires a notice to be delivered within 14 days for keeper liability to be established. Delivery is assumed on the second working day after issue, so to me it looks like only one of those meets the criteria.
Theres a lot of other wording required too, so that notice may also not be compliant even if it meets the 14 day limit.

There is no mention of a "notice to owner" in The ppssCoP

ECP NtKs are never POFA compliant as they omit several of the requirements set out in POFA Schedule 4 Paragraph 9(2).
3 -
…… and nobody knows who the owner is as it specifically states on the front of every V5C that "this is not proof of ownership".

How did they obtain data to issue the NtO as the KADOE contract specifically states:-
"A2. Purpose of this Contract
A2.1. The purpose of this Contract is to set out the basis upon which the DVLA
agrees to provide Data regarding the keeper of a vehicle at the date of
an event to the Customer, on request, using the electronic service
detailed in the KADOE External Interface Specification, and the
Customer agrees to pay the DVLA for that service."Perhaps the OP can post a copy of the reverse of one of the NtK and one of the NtO?

They can't issue NTOs. I don't understand why they've even created that document! There is no such thing on private land. Never seen this from ECP, what are they playing at?Those are clearly designed to impersonate local authority penalty NTOs and that's misleading & unlawful under the DMCC Act 2024.
Easy to appeal but the flip are Euro Car Parks doing? The Code at Annex E says this:
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

They have been issuing NTOs for years no idea why wonder if site specific

I've never seen one!
Breaches the code but also impersonates authority, so it is unlawful per the DMCC Act.

Yes, the generic appeal is in the NEWBIES thread. Which we won't link!
Here are your images with the VRM redacted:
The top one is an NTO (not allowed) so just appeal all the NTOs first, citing the Code and telling ECP you will report them to the CMA and BPA if they don't cancel these notices because they misrepresent the charge as having statutory authority.
The second one does mention the POFA but doesn't quite get the wording right. Use the template appeal for those ones or just ignore those.
Concentrate on killing the NTOs, which is very easy. No paying any of them!
