Judegment for Claiment but no previous letters received

I just got a letter through from the county court stating I owe DCB Legal approx £300 for not replying to the claim form.

I have not received a claim form for this in the past and have always responded to the claim forms sent to me.

Is there a way to appeal this or get the claim form resent to me? Or is there any other advice anyone can give to help?

I am trying to get through to the county court on the phone but am struggling to get anyone to talk to.

Not appeal, not resent, just a set aside !

It wont be the county court, it will be the CNBC in Northampton, now closed. !

    Name the private parking company

It was from Parking eye but I have no idea about the alleged offence they are referring to

There was no offence, never is in private parking company cases, just an alleged breach of the parking contract on that private property

Presumably the claim form went to an old address. ? So was incorrectly served, if true ?

Have you moved in the last 6 years. ?

There may be a solution to this ( off the forum. ) once certain questions have been answered

I moved house 5 years ago but that's a long time for them to get the address wrong. I have also defended other claims stating my current address is my address of correspondence.

I was looking into getting this set aside, but unsure how the exact process works or if this is the right thing?

A set aside costs around £321 , for incorrect service of papers ( the CNBC would tell you the same if you had got through. )

My advice is wait for further replies, possibly a PM from another member here , for an off the forum solution, no rushing

If you dont understand the Justice System process, then you have not studied the CCJ advice in the 2nd post in the newbies sticky thread in announcements near the top of the forum

Thanks for the reply, I have read the CJ advice on the newbies post but it seems to mainly refer to people who have moved address which I have not for a long time.

I actually have no idea what this is about as I have been very on th eball with responding to letters of claim.

Will the CNBC be able to tell me where this even originated from?

Yes they will, and can email you some of the claim form information, name , address, POC etc

Phone them tomorrow morning, early doors, when the phone queues are short

Get the details from the CNBC first, including which address the claim went to, and get them to email you the POC.

Then send me a pm next week to remind me. I'm on a short break till Tuesday.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • I called CNBC today and got more details and they emailed me the details. It was from a hospital car park in early 2022. They state they sent a claim form in early September but I never received this.
