Complete the AOS online stage first, on MCOL , by following the 8 steps

    Then adapt the 10 paragraph defence template, paragraphs 2 & 3 ( use all 10 paragraphs )

so do i add that it was essentially a keying error and that a ticket was paid and displayed on the vehicle, did appeal and try to charge us £20 but it wasnt paid think we just lost the paperwork. Or do i need to spruce it up a bit. Add mum was diabetic was stressed as attending family court that day

I wouldn't be saying all that in a defence , problems with keying errors are usually faulty ECP payment machines

Just state that full payment was made so the defendant denies the allegation of non payment

Study other similar recent ECP cases to see what they wrote

Looks like the issue date is 21 Sept. If so then the service date is 26 Sept and the AOS has to be done by 10 Oct. And the defence submitted by 24 Oct

If the issue date IS 21/09/26 and providing you complete(d) the AoS before or on 10/10/26 your defence deadline date is 4.00 p.m. on 26/10/26 - defences are never due on a week-end or a bank holiday.

It wasn't 'received on' 21st then.

But it is a cinch to defend and tell the Defendant it will end up discontinued in 2027.

Do include in para 3 that the Defendant denies the allegation: she did purchase a ticket but inadvertently entered the incorrect reg which the Claimant knew at appeal stage. Therefore there was no loss and the Beavis case is distinguished, not least because the Defendant is a Type 1 (or type 2?) diabetic who was particularly stressed due to attending family court that day. The Defendant's PCN should have been fully cancelled on appeal as a 'reasonable adjustment' under the Equality Act 2010 in recognition that the typo arose as a result of her disability.

However, what makes you so sure it was her typo?

Did she type in the wrong car entirely? If not, it is much more likely machine error, look at this video:

    https://www.bbc.co.uk/news/articles/cdeln2ly1z0o

    Did that happen to her?

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

hi Apologies for late reply, been busy with stuff. Still need to make the defence but yes something like this happened. i recall she incorrectly entered the reg by a couple of letters i believe and we did appeal and it was reduced to £20 but she misplaced the response and never made the payment and evidently we are npw here

Has your mum completed the AOS stage online on MCOL yet. ? ( to gain extra time. ), we hope so because busy or not, there are important deadlines, as outlined above by Le_Kirk. !

If mum was the driver and if she is the defendant too, she adds w words at the end of her paragraph 2, and driver

Use the response by coupon mad above as her paragraph 3

Use all 10 paragraphs in the defence box on MCOL, no need to wait
