Publicly accessible car parks are subject to the rules of the road, under the assertion that https://www.legislation.gov.uk/ukpga/1988/52/section/192/enacted states "“road”, in relation to England and Wales, means any highway and any other road to which the public has access, and includes bridges over which a road passes,", which includes the roads within public car parks.

Therefore, as I said, the requirement that number plates must be legal is already implicit.

A) Whether a car park is a road is actually a more difficult question than you might think and it's not a straightforward answer.

B) By including in in their terms, they can take action if that clause is breached. They cannot do so if it is not in their terms, because they don't have a cause of action under the display of registration marks regs.

For some reason the ANPR cameras cannot read my VRM even though it's a perfectly legal, standard and compliant plate fitted from new by a BMW dealer. Inevitably autopay fails but they still manage to send a PCN a couple of weeks later. I think to date I've succesfully challenged 18 of them.
