Another parking eye...and failure by mother!
Evening folks. Bit of advice required.
My mum parked in a Lidl car park in Glasgow for 45 minutes to eat some lunch with a niece but didn't use the shop and didn't realise there were cameras. She received the fine from Parking Eye and then appealed it on emotional grounds. Only after that did she tell me that she'd appealed it, and I didn't have a chance to correct her response in line with some of the helpful advice on this forum!
They've come back with the attached knockback. Any way I can get out of this or can I just ignore it?

Complain to Lidl, but I doubt there’d be much sympathy (unless your mother is a regular shopper with them and can provide them with some proof of patronage). Otherwise, there’s little more to do, other than ignore this - especially as it’s a case in Scotland (no keeper liability, for now!).
A POPLA appeal would be hopeless, and a defeat there would encourage PE to crank up the intimidation. Let’s see what they do from here - unlikely to be anything more than silly threatograms from them or from harmless debt collectors, DCB Limited, who can be totally ignored.
We’re always here for ongoing advice …. if anything moves on (highly unlikely). Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thanks. So suggestion is just to leave it and not pay?

I suggest that you also educate her in the big brother of today, cameras are everywhere, especially commercial premises like supermarkets ( if she assumes that she is being recorded everywhere away from her home, forewarned is forearmed

Obviously no paying. It's not a suggestion!
Nobody in Scotland has to pay a private parking charge and it's a bit surprising a driver took this invoice seriously and said who was driving! Totally the wrong move.
Nothing will happen but your family needs to take on board that the law will change sometime next year when you'll get 'keeper liability' on private land (doesn't affect this invoice; laws aren't retrospective).
Make sure she doesn't start phoning DCB Ltd and talking to them (or worse, paying) when the £170 threatograms arrive.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Please stop calling this a "fine" it's just an invoice from a company that has found an easy way of making millions by scaring people, Parking Eye feed off these events, they don't really want to stop them happening and certainly won't listen to "emotional grounds" the only emotion these people show is happiness when their end of year profits get published.

I suspect it also depends on what she wrote. There is not requirement in Scotland to declare who the driver and therefore it best not to do so. Further what was the breech? They state you have not provided evidence to prove the breech didn't happen, it's up to them to prove the t&c's were breached. Have they provide that?

There is no requirement to identify the driver outside of Scotland either.
I'm a random person on the internet. I hold no legal qualifications and nothing I say is advice.

Never seen a Scottish one go anywhere near a court.
