PREMIER PARKING /GLADSTONES COURT CLAIM

Hi good afternoon all. I have just received a letter in the post from HM courts service.

This was from Premier parking at The Wharf on bridge Street Birmingham. It says i was not parked wholly within the bay.

What actually happened was we drove into the carpark. There was 2 cars blocking our way so we couldnt drive forward. I then got out of the car and then my wife got into driver side and tried to move but she couldnt as there was 2 cars in front blocking the way. There was a parking attendant in a van behind us that had taken pictures of our car. I went upto him and said we cant move because of the cars infront. He ignored me.

I then went into the office and then my wife moved the car.

I did appeal the the PCN but it was rejected and I wasn't given a POPLA code. I ignored the letters and threats up until now.

I have now made this thread to ask for some guidance please on how to challenge this court hearing.

If it helps at the time of the PCN I was currently on sick leave due to stress and anxiety. I am still in the same situation but getting better and will be returning to work soon .

Would this help my case.

Any advice welcome.

Its a court claim ( not a hearing ) post the issue date from the top right of the claim form below

Also post the EXACT name and address of the claimant, because its not Premier Parking

Also post a redacted picture of the POC from the lower left of the claim form below after hiding the VRM details first

The case will centre on the facts

You left the Claim reference number showing, issue date 2nd September 2026

The claimant is actually Premier Parking Enforcement, of Stourbridge , so no chance of a popla code

The Alleged breach is pleaded, what you described in your opening post

Not parked wholly within the bay

Follow the 8 steps in the defence template thread in announcements near the top of the forum

Complete the AOS online stage ASAP on MCOL

Then adapt the template defence

Would my Mental health sicknote help my case or is there no use even mentioning it.

Also can use a chat GPT defence too.

Did you park your car in the car park after the initial issue with access? And pay for parking? How was payment made, and Do you have evidence of that payment?

Did they include any evidence with the initial pcn? Photos of the car etc? If you cN share that it would help.

It was a free carpark but I think the rules were you had to park in a bay.

They did send out a link for me to view the pictures but now the link doesnt work. I Will try and get pictures for you.

Hi, I have just submitted to AOS.

My question is how do I adapt the defense to suit me.

Use the standard defence template and adjust your paragraph #3 to refute the POC.
