Order with right street name wrong postcode - courier "guessed" address

OK it was my fault - correct street name and house number (lets call it cat street). Incorrect post code (my old post code). Let call it AA1 1AA.

So parcel goes to AA1 1AA. There is no cat street, just a dog street. Parcel is addressed to 37 cat street.

So courier takes a guess and delivers it to 37 dog street.

I've gone back to visit this address and they say they never had it (which is a lie!) BUT I've tried to say to both the merchant and credit company they've guessed the address here - it should have been returned but they say nope.

Where do I stand legally here?

(and yes there are some right scumbags around - when I knocked on this guys door you could tell he was lying and the parcel had been delivered here - in fact, the merchant has sent me photographic proof).

    Couriers/postmen only use two parts of the address, the postcode and the house number, the rest of the address is superfluous these days

    Royal Mail work based on postcode. If there is a postcode AA1 1AA with a number 37 it will be delivered to that address.

    Pretty sure that the last time someone asked similar there did not seem to be an absolute right or wrong.

    I'll try to find the thread but I think in the end the consensus was 'your mistake - tough' and all you can do is ask nicely for some goodwill from the courier and/or the supplier (which you might already have done).

    EDIT: Seems that previous thread was OP asking the same thing in July. Don't think anything much has changed since.

    Presumably you are @paul2foel. Why have you posted again under a different username?

    You admit you got the post code wrong - one of the most important parts of an address.

    As explained in the previous thread, under s29 of the Consumer Rights Act 2015 the goods remain at the seller's risk until the consumer takes physical possession of them.

    You can try to argue with the seller that they did not deliver the goods into your physical possession - but they will point out that this is because you provided a non-existent address. You can try to argue that the courier should have realised the address did not exist.

    If the seller won't accept your argument you'll have to decide whether it's worth suing them. Whether you win will decide on whether the court adopts a literal interpretation of the statute (you win) or a common sense view (you lose)

    Strictly speaking the court ought to take a literal view, so you might very well win. Or you might lose…

    Are you eligible for a s75 claim?

    Makes no difference, all company have to prove was it was delivered.

    Couriers just use the house number and postcode for routing - they did that correctly based on the information you provided. You're going to have to chalk this one up to experience.
