Money claim DCB Legal/ParkingEye
Money claim received & AoS submitted via MCOL
Previously appealed to POPLA but was unsuccessful and proceeded to ignore debt collecting letters following.
The car park in question has 1 hour free stay, I was 18 minutes over (only 3 minutes if the 5 minute entry/10 minute exit grace period applies but I'm not 100% if it does since I didn't purchase a ticket in this instance)
I (the defendant & driver) and my husband entered at 10:52am/left at 12:10pm - we purchased food on site at 11:47am so my husband could take medication, this is my defence. I still have a copy of the food receipt which I sent in the email to appeal.
I have read through newbies post & defence template but a lot of the template doesn't seem to apply to my specific situation, do I just edit that out? Any advice is greatly appreciated so I don't mess up my defence. Thank so much!

With an issue date of 20/08/26 and providing you complete(d) the AoS before or on 08/09/26 your defence deadline date is 4.00 p.m. on 22/09/26
The POC as shown on your claim form are inadequate/poor so you can use the defence template that points you towards Chan & Akande via links in the template defence thread.

Do I still take snippets from the original defence template, or do they not apply for my situation? Sorry to be a pain, I struggle to comprehend it all completely and I get easily confused! Thank you for your time and help!

Use the 10 paragraph Chan and Akande defence template, no changes, no snippets, your situation is to use it as is

Just to be sure I understood correctly, I use the 1st comment on thread:
and add my specific details as mentioned above as paragraph 3? Do I also include the copy of my food receipt ?
Thanks so much for your time!0 -
No, look at the section starting with and includes DCB LEGAL and Parking Eye below
Use that as paragraph 3, using paragraphs 1 & 2 and also paragraphs 4 to 10 in the defence template thread, unchanged
No evidence is submitted with the defence and you won't be using your specific details either
...unless you have a
CEL (in-house only), Elms Legal, Gladstonesor a Moorside Legal claim without the alleged breach/reason specified(and also specifically for DCB Legal claims for ParkingEye or Group Nexus / CP Plus) in which case, you can use this wording as paragraph 3, re CEL v Chan and CPMS v Akande, here4 -
so a simple copy & paste job, I've been stressing about this since I received the claim and it seems too easy 😅
Thanks again for your guidance! It is very much appreciated!2 -
"we purchased food on site at 11:47am so my husband could take medication,"Does your husband have a long term medical condition and did you tell ParkingEye about that on appeal?
Sounds like the slight delay was due to needing more time to accommodate the needs of someone with 'protected characteristics' per the Equality Act 2010 and they turned down a valid appeal (and so did POPLA).
Quelle surprise
Failure to make reasonable adjustments of time. Yet again. Now suing you 5 years later.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Yes, my husbands condition is not curable, he now has a blue badge but unfortunately didn't have one at the time. I sent all information to POPLA and my appeal was still unsuccessful

He may not have had a blue badge back then, but he may have had protected characteristics under the Equality Act 2010 back then, as now !
3 -
should I add that in to para 3 or still not to add any of my specific details to it just yet?
