You always have the option of declaring yourself as the driver so that your wife is removed from the situation entirely. Then you can defend any court claim that will inevitably be discontinued.

Secondly, do I need to be concerned about what little evidence I have to put into a money claim defence and witness statement or do you think it is enough when placed alongside evidence from previous double dip cases?

Remember, a court claim is the opposite of Popla. The onus is on the claimant to make their claim, not for you to disprove it. If you state it's a double dip on a signed court statement it is taken as gospel and they are obliged to disprove it.

Thank you for your response. When researching other claims I've come across the information you have provided regarding the camera checks UKPC should make and the proof of the vehicle being parked on site so I will appeal to POPLA using those arguments. I will also point out the fact that the notice is for 36 seconds beyond the minimum grace period of 10 minutes. For information, in my appeal to UKPC I did make a loose reference to camera checks regarding 'double dip' and they did include in their response a comment about UKPC sites having regular checks but nothing specific to the site in my case so I will make that point to POPLA referencing proof/evidence of checks at my site.

Thank you for your response. Regarding declaring myself as the driver, that is a good point which will remove my concern regarding my wife and court. The one reservation I had with this is I had always believed advice is never to name the driver but I may be wrong, I guess at some point I may need to use this tactic to ensure it is me who goes to the end of the line and not my wife.

The advice not to name the driver is only to stop people doing that in a non-POFA NTK case.

Mostly, UKPC use the POFA, so it doesn't matter when she names the driver. As long as that's done before a claim form is issued.

Also, must admit I haven't read back on the thread but if this is a 'double dip' situation why hasn't the landowner stepped in and cancelled it for you & your wife? Much easier than wasting time on POPLA.
