"I will escalate the matter to the ICO and CMA when you reply, no doubt toeing the well-trodden IPC path of shutting down my dispute and data objection and continuing to demand inflated money that is not legally owed."

I've just been re-reading the letter before claim and in it it states this….

How does one enter into a contract by conduct?

It sounds like there are no terms and conditions displayed other than perhaps entering ones VRM into a terminal, but even that should be made clear with adequate signage.

The parking company are trying it on without a legal leg to stand on.

Well they're not wrong. But it's an irrelevance. It's just throwing in some legalise to intimate rather than having any legitimate purpose.

The area marked in green is the location of our entrance sign and camera positioning. The entrance sign does satisfy both the Code of Practice and data use/surveillance laws. Such as: - (a) clear disclosure that ANPR/CCTV enforcement is in use before the recording field begins, and (b) the exact identity of the operator (data controller) and (c) direct contact details or a URL to read the operator's full 'privacy notice'.

Each arrow on the below site map depicts a sign on site, and shows the enforcement area and where our posts are mounted..

The 12 feet high pole mounted CCTV camera and laminated paper you have referred to have been put in place by Londoneast-UK, not One Parking Solution Ltd.

Seems like the initial camera and lack of signage upon entry is on Londoneast’s part and they’re happy their signage within the car park all the way down suffices.
