Letter from courts & tribunal service for parkingeye charge

Hello, I’m looking for some advice.

4 years ago I attended a hospital appointment at the Bowthorpe community hospital in Norwich, Norfolk, for an appointment with my disabled son. The payment machine wasn’t working and I could not miss the appointment. So I took a photograph of the machine and attended my appointment. When I returned to my car it was still broken and not accepting payments, other people were having the same problem too, so I just left.

I stayed receiving letters late due to a change of address and still attempted to submit an appeal but it was rejected due to being passed the date of appeal. It got passed to DCB legal who I contacted and they were just rude and refused to help, so I left it again and now this has come through saying I need to respond in 14 days. I am not paying their fine as I should never have been issued one in the first place had they actually checked that their payment machines were working.

There was no pay by phone in the carpark then as far as I remember but due to being in a highly stressful situation with a distressed 1 year old with physical disabilities, I didn’t take photos of the signage.

I really don’t know if I have a leg to stand on with not paying and what do do from here. Any advice would be appreciated.

Thankyou!

You won't be paying. Follow the advice on the newbies post and ask questions if it doesn't make sense (lots of people need to ask, as did I previously).

You have 2 defenses - proof that the machine didn't work and so you couldn't pay & reasonable adjustments where they need to be understanding of someone with disabilities (your 1 year old).

Do be sure that you tell them to erase any old address they have for you as well as email or phone numbers so they cannot easily harass you. The only form of communication should be by post and you should respond in the same way.

Have you received a N1SDT claim form from CNBC? If so, you cannot afford to ignore this one; what is the date of issue of the claim form? What does the POC state?

@Le_Kirk im not entirely sure what those are? There is a claim form and a response form with a defence part, is that what you’re referring to?

Yes, the claim form is the N1SDT and IS official. The good news is, you don't need to fill in any paper forms, this can be done via MCOL which is reached via your Government Gateway account and is all done online. Most people have a Government Gateway account because that is how you organise your tax affairs.

What is the date of issue of the claim form? What does the POC state?

If you now have a Claim Form then you do know what it is (because the paperwork tells you) and you must defend.

Read the Template Defence thread and crack on with the easy 8 steps urgently.

What is the date of issue of the claim form?

What does the POC state? Show us a pic.

Breach not pleaded, do the AOS stage online first, then use the Chan and Akande defence template from announcements near the top of the forum

There's a VRM left showing in the POC.

    Here's a redacted version:

    DCB Legal then.

And they reckon that they can add £70 false 'damages' to collect £70! Unlawful add-on and no breach pleaded. Usual crap.

They'll discontinue by the new year. Defended cases are all discontinued because they are after CCJs and money, not hearings.
