Harvey Nichols gift cards rights

Hello,

Does anyone know the rights that I have with regard to Gift cards which I recieved from my birthday. I went in to spend them and was advised they cannot accept them due to the take over. No warning communication was given to me. I knew about the buy out but nothing was communicated to existing customers of anything changing.
thanks Linda

They only went into administration on Thursday, it's not the sort of thing anybody can give meaningful prior notice about.

That nice Mr Ashley might let you use your gift cards to buy some replica football kit or some cheap trainers once he's finished gutting the Harvey Nicks chain of any bits he can flog off.

Any consumer rights rest with the person who purchased the gift cards, so wait and see what the outcome of the takeover is and if you still can't use them, speak to your donor and see if they're willing to escalate it.

If these were physical gift cards, how would Harvey Nichols know to contact you and warn you?

Harvey Nichols went bust, no one has any enforceable consumer rights for gift vouchers.

You can add your claim to all the other creditors, but are highly unlikely to get anything back.

The purchaser could try section 75 or chargeback if the purchase meets the criteria.

Fraser group may honour the vouchers.

Who bought them needs to contact,

Outstanding issues or refund requests must be directed via email to HNCustomers@fticonsulting.com.

No retailer would contact you, given they will not have been registered to any of your contact details.

Not forgetting no one knows they are going into administration, till administrator takes over & staff get told they are now out of a job.

With Mr Ashley taking over all physical gift cards are good for will be scraping ice off in winter 🤦‍♀️

I knew the business had been bought by Frasers, I hadn't realised of any administration. Hope you get the gift cards sorted.

I will no longer purchase gift cards for anything other than Amazon for exactly that reason. Even Amazon cards do carry a risk, albeit a smaller one than any other company that I can think of.

I'm amazed anyone still uses them. As well as these circumstances, there are many tales of cards not being activated, having zero balance, credit being stolen, etc and in all of those circumstances it's a faff working out who's liable and then getting the purchaser to exercise their rights.

A voucher is no less "I couldn't be bothered to put the thought into a genuine gift" than cash.
