DBCL Final reminder

Hi

1st post Newbie here

I received a final reminder letter from DBCL (1st letter ever received, no previous letters received from Euro Car Parks) relating to an alleged PCN

I paid for parking via the pay by phone app on the 20th April to cover 1 hour

I entered the car park at 9.37am, took 3.5 minutes to park (Find a spcae, exit the car to read the site location and app details, return to car, paid for parking at 9.41am). I returned to the car and left the car park within the 10 minute grace period at 10.50 (1 minute before end of grace period)

In my opinion a PCN should not have been issued in the 1st instance.

I moved house and have only just updated my logbook details, My license was updated 2 years ago when I moved house - my fault on the logbook as due to a breakup I only updated my license when I moved house, Forgot about the V5 as was lost in the move

I am sending the letter below off to ECP today

The above vehicle was parked at the Charter Street car park in Manchester on the 20th April - Location 685770

  • Car park entry 9.37am
  • Reviewed signage within 4 minutes of entering the car park to acquire payment details and 1 hour parking time was purchased.
  • Payment started at 9.41am after reviewing signage
  • Car park exited at 10.50am (within 10 minute grace period as outlined within BPA code of practice period by 1 minute)

See below camera information and paid parking receipt
An initial letter was not received directly from ECP to state that a fine was going to be issued for legally parking as above so no fair opportunity was available to appeal within the standard allotted timescales
Instead a letter was received this morning (Post dated 3rd August some 4 months after the legal parking session) stating that it has been passed to DCBL collections and now the fine has been inflated severely to £170
Can this be cleared as the vehicle was parked legally and car park vacated within the standard grace period of 10 minutes after returning to the vehicle

Any assistance on what to do next would be greatly appreciated

Thanks

Adam

Firstly it’s very likely you won’t be paying any amount. Have a read of the “Newbies” thread and a few others if you are unsure.

Appealing to ECP is probably a waste of time as your PCN is now on the standard conveyor belt which is what you want. Again see the “Newbies” thread

Ignore the threatograms that you will receive but keep an eye out for the LBC letter that you will eventually receive

Update your current address on the DCBL app, plus email the DPO at ECP with your current address for the service of papers, with proof, such as a copy of the new V5c document

Then wait for the inevitable LBC and Money Claim from DCB Legal

Meanwhile, email the CMA with story etc

    Thanks

I have updated my address on the DCBL app, Sent an email to ECP with an update of address and have made a complaint to the CMA

I have still issued a latter to ECP stating that it shouldnt have been a PCN in the 1st instance as I left within the standard grace period

    Will wait further letters

    Thanks

Given the CMA fine to ECP which is now with the High Court, it seems that ECP are giving the CMA more evidence of their antics

    Nicely done.

    • Hope you confirmed your new address to DCB Ltd (yes we know they traced it already, that's not the point, you MUST tell them to 'erase' the old address. This can be done on their Portal).

    All defended claims are discontinued.

Please show us your evidence here too as I can use this for my evidence to the Government. Need to see the NTK with all dates & times showing, plus the app record of when you paid, please.

    • Hope you sent the CMA your actual evidence above, to help them (the NTK and proof of payment times), because this is right up the street they are walking down with their Euro Car Parks investigation.

No consideration period = an unfair term.

You'll never have to pay this invoice.

Not even when DCB Legal file a court claim because the well-trodden (100% documented here) MO with Euro, is that the court service is only used/abused to spend £35 a pop to bung in boilerplate claims and harvest default CCJs to frighten and intimidate people.

    All defended claims are discontinued.

PS how do you ask them to erase your old address can this be done via email ?. The app is showing my current address but when I go on the app and go to send message the top dialogue box asks for a reference number but does not let you type a number into it, This unsaved field does not allow you to click the submit box which stays unhighlighted

Just email them the first wording shown in the LBC response (post 2 of the NEWBIES thread tells you all about it). Albeit you don't have a LBC yet, only the daft £170 threatogram you saw in the pictures when you read post 4 of the NEWBIES thread before posting.
