    Ref the mis selling of car finance, I have written to the company and the finance company concerned, I could tell them the loan number and when the loan was taken out etc. They say they destroy records after six years so have no details of the finance agreement.

    They asked if I could provide any more information, which I cannot as I had a clear out a while ago, and suspect I threw away the agreement as I no longer have the car.

    They have since written back saying I have no claim. What should I do now, I was thinking of going for a no win no fee option

    Has anyone else got this response? What are others doing at this stage any ideas please

    The FCA proposed scheme for Car Finance is currently under legal challenge. As currently drafted the rule CONRED 5.2.25R would require them to try and reconstruct their file so if the FCA win the tribunal and the scheme isnt changed, simply saying you dont have a file any more will not be acceptable to the scheme rules.

    No win no fee companies do not have ANY powers that you don't have, they use literally the same free of charge complaints process you do. They do not have access to paperwork, they cannot magic up documents you and the firm have disposed of. They are good at lying and convincing people to hand over 30%+ of any refund based on their "specialist knowledge" which in reality is some minimum wage call handler sending off the same form you would do.

    You will need to hang on as above and see but I wouldn't hold out much hope if they have no idea who the finance was arranged through, if they had any deal with the dealer or even if they used DCA on your deal etc
