Court claim - CIVIL ENFORCEMENT

hi

interested in any advice on how you might deal with this. Have received a claim from HM courts and tribunals by way of civil enforcement Ltd.

So as far it goes, an overstay was alleged and a debt was implied of £60. The stay was noted by them as 20mins over an allotted time of one hour spent in a supermarket.

The debt now however has been increased to nearly £300 which includes a larger claim of around £200 now plus fees.

What would be the process from here?

thanks in advance for any advice one may have one this.

kind regards

The actual pcn charge would have been £100 and never changes

Is it an in-house CEL claim ?

Post the Issue date from the top right of the claim form

Post a redacted picture of the POC from the lower left of the claim form below too

Then study the first 2 posts in the defence template sticky thread in announcements near the top of the forum

Then read post 2 in the newbies sticky thread in announcements too

Wow CEL are churning them out this month!

They are also discontinuing those that have been defended & reached a hearing date being allocated. No hearings recently! Nobody has paid any money.

Read any other CEL claim thread from yesterday and show us the POC please and post the Issue date from the top right of the claim form

We know everyone is a newbie so that's why the common acronyms are in post 5 of NEWBIES PLEASE READ THESE FAQS FIRST.

No link. See my signature below for how to navigate to page one in a nanosecond

"Where would I find other posts on CEL claims?"

Literally by skim-reading thread headings starting at page one where the NEWBIES thread calls to you at the top.

Read that. Then just hop back to view page one and work your way down the thread titles, like looking for a book on a shelf.

Look at the first half dozen pages for CEL threads. Shedloads right now.

With an issue date of 16/07/26 and providing you complete(d) the AoS before or on 04/08/26 your defence deadline date is 4.00 p.m. on 18/08/26

    thank you.

regards the defence should I use the template you have listed.

I basically haven’t seen the sign clearly. I haven’t been back to see how prominent it is however I didn’t see it,

I have messaged each time stating I am not aware of any debt owed. I have stated if a debt is owed I will happily remedy this. On each occasion I have asked for a proof of debt / contract and that the debt is owed to you.

I have been ignored each time and sent repeated correspondence time and time again asking for payment. The £60 I believe was a reduced settlement figure to pay which again I stated I would pay should the aforementioned be provided.

Use the template defence and refute what was written in the POC, i.e. you overstayed the 60 minutes, although the POC do not actually claim that, merely stating a fact that "Maximum 60 minutes free parking". You could be cheeky and use Chan & Akande as "the breach was not properly pleaded".

Search the forum for Leagrave and copy that defence. I assume you found that one already when you read CEL threads by simply starting at page one and looking at thread titles to click on and read, but there's a pointer for you to learn how to search the forum too.

@coupon-mad there are a tonne of posts with Leagrave.
is there a particular one you recommend I look at?

I have looked through many but can’t see one which hosts a defence other than this:

also @Le _kirk thanks for picking up on POC not stating overstayed. That said what do you mean exactly when you say I could use the point that ‘the breach was not properly pleaded’.

Also, to date uni have simply responded each time stating the same, if a debt is past and post due I would happily remedy said debt should the debt be valid and owed to you, thus asking for proof of valid contract/agreement.

At no point have I admitted anything along the way and the fact that I had not seen this parking notice is surely not grounds for for assumed consent. As I am aware full disclosure is required to any civil contract to be 100% valid and watertight along with said agreement.
