Civil Enforcement & KFC
Hi all my wife got a PCN for parking over time in December 2025. We ignored all of the notices from them and they eventually sent a court summons N1SDT. After reading through the threads on here I used the AI tool and generated a defence. Which was very good and easy to use.
She has today received a witness statement from CEL with no mention of her defence which is a medical emergency as she is a Type1 suffering a hypoglycaemia. She is by law not allowed to drive whilst suffering one, and for 45 minutes after her blood glucose as returned to normal. Meaning she was unable to move her car in the time frame of 90 minutes.
Looking for advice on next step please.

Definitely wasn't a summons, just a Money Claim from CEL, ( are DCB LEGAL involved or not. ? )
Post a verbatim copy of the defence below, minus any personal information
What stage is she currently at. ? CNBC or local civil court. ?
Post the hearing date, hearing fee deadline date and WS deadline date from the court order from your local civil court

At CNBC, CE are suggesting the hearing be conducted remotely. No Dates yet.
Will copy and post defence shortly.

DEFENCE
Claim Number:
Claimant: Civil Enforcement Limited Defendant:
DEFENCE TO CLAIM
- The Defendant admits she was the registered keeper and driver of vehicle registration ...........on 20 December 2025 at KFC Welshpool.
- The Defendant denies liability for the following reasons: Medical Emergency
- The Defendant is a Type 1 diabetic, diagnosed in 2000. She uses an ‘Abbott continuous glucose monitoring device’ which monitors her blood glucose levels every 15 minutes and sounds an alarm when levels fall below safe limits.
- On 20 December 2025, whilst preparing to leave the car park, the Defendant's glucose monitor alerted her to hypoglycaemia (dangerously low blood sugar).
- Under DVLA guidance, it is unsafe and unlawful to drive during a hypoglycaemic episode. Drivers must wait at least 45 minutes after blood glucose levels return to normal before resuming driving.
- The Defendant had no choice but to return to the restaurant to treat the hypoglycaemia and wait the required time before it was safe to drive. This was beyond her control and a medical necessity.
Denied Right to Appeal
- The Defendant attempted to appeal this charge through the Claimant's online appeals system. The system repeatedly failed, preventing her from submitting her appeal (evidence: screenshots attached).
- The Claimant is not a member of the British Parking Association (BPA) or International Parking Community (IPC), therefore no independent appeals process was available.
- The Defendant was denied any opportunity to have her case fairly considered before court proceedings were issued.
Signage Issues
- The signage at the location was unclear and did not adequately communicate the parking restrictions.
Proportionality
- The charge of £100 (reduced from an initial higher amount) is disproportionate and constitutes a penalty rather than a genuine pre-estimate of loss, particularly given:
- The medical emergency circumstances
- The Defendant's attempt to appeal
- The failure of the Claimant's systems
- The Defendant requests that this claim be dismissed, or alternatively, that any award be substantially reduced to reflect the exceptional circumstances.
Statement of Truth
I believe that the facts stated in this Defence are true. I understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth.

Then she received the much too early template WS issued by CEL, ignore them and follow the 8 steps in the defence template thread in announcements near the top of the forum by coupon mad
I would expect that the N180 DQ pdf document stage is next. ?

"

The D should have just used the Template Defence but no worries.
The early WS from Syed whatsisname has been discussed a lot and is a template. Ignore it, if you aren't actually past DQ stage yet.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I note that they say appeals can only be submitted in writing, but on their web-site to pay, it shows an option to appeal. I tried to use that at the time, every time I tried over a few days it when to a fault so I took screenshots as I was thinking it was just scam.

OK, save all that for WS stage before the hearing. CEL usually discontinue.
