Illegal eviction, what can I claim for?

It says I have to inform them if I'm going to be absent for more than 28 days which I did.

I know when I stopped paying rent, but I don't know the exact date they took over the property from the previous landlord or when they repossessed it.

Even if i was in breach, the question is whether a judge would think a no notice eviction was an appropriate remedy.

The problem is, this is criminal law rather than civil law… the landlord needed a court order to terminate your tenancy, and by evicting without one s/he committed a criminal offence. Did you make a police report? Have you sought advice from Shelter?

Regardless of whether a crime has been permitted you can still pursue someone in the civil courts no? I've never heard of someone being obligated to pursue a matter criminally.

I haven't made a police report because after my experience with the police that would be like doing a deal with the devil. I don't want to get those monsters involved if I don't have to.

The rent arrears transfer over from one landlord to the next, as your tenancy agreement remains intact.

Your new landlord may have served papers advising you to the property address.

Can you not get access back into the property which you have a valid and legal tenancy for? What about any support from prison service?

You informed your old landlord that you were on remand and would be absent more than 28 days. At that point you were up to date on rent?

The landlord sold the property on what date?

You need to find out when the new landlord sent notice of their ownership and bank details. Until that was provided, you did not have to pay rent.

Even if your new LL wanted to evict you, they need to comply with the law. That changed on May 1 2026 so exact dates now matter. It affects notice etc.

How were you planning to pay rent? Bearing in mind that being on remand, you were entitled to UC for housing, if you claimed?

Suspect the LL is going to claim you abandoned the property.

Please speak to Shelter urgently.

This is pretty simple. You need to add up all your costs and deduct the rent.

I don’t see why the eviction date matters. You claim for your bail hostel costs until now and deduct the rent you would have paid until now.

The landlord will contend that you abandoned the property, and the judge will decide on the basis of the evidence.
