double dip charge - over stay 2024
Hello,
Around 2 months ago I received a letter in the post from DCBL with a charge of £155 for overstaying at a Euro Car Parks in Sainsbury’s dated in June 2024.
Unfortunately missed the initial letters due to not updating my logbook address so the letters were all sent there.
After a back and forth with DCBL to see the evidence and then my only option being a DPO to Euro i’ve now received the ANPR images that show me entering at 8:35am and leaving at 18:15pm.
The timings line up perfectly with me visiting before work and after work, I have bank statements showing 2 purchases at the store along with me collecting a parcel from the argos in store. I also have messages with my partner on that day where we discuss me going back there to get fuel, collect the parcel and to do another shop.
I’m at a bit of a wall in what to do now, i’ve replied back to the DPO email with the evidence of this but i’m at a bit of a wall on what to do now or if there’s anything else I should be doing.
I definitely didn’t over stay which is what their allegations is. They also state that they delete any images within 14 days so I have no way of seeing the missed captures between.
Many thanks in advance!

Do you have any evidence you were at work during the day? Timesheets, access logs, badge scans etc?

how long have they said the overstay was?
the first place to complain to is sainsburys.
is this a local store?

@Nellymoser - a new one for your double dip thread of shame.

they haven’t stated how long the over stay was, just “your vehicle has overstayed the maximum time period allowed”
Spoke to Euros over email with proof and they’ve said they will not correspond as it’s now been passed to DCBL
it’s a local store to me, large sainsbury’s super market

thanks for the reply! unfortunately no actual evidence as we don’t have a badge system at work or any clock in or out. our cctv also doesn’t go back far enough. only thing I have is our work calendar which shows me not off sick or on holiday and an email from my manager.
Euros have also got back to my appeal with evidence saying they’ll no longer correspond as it’s been transferred to DCBL debt agency

What about any meetings, emails you sent, colleagues you would have seen?
Its unlikely to ever get to court, but if it does it will come down to balance of probabilities so the more evidence you have the better.

Try plan A in the newbies sticky thread in announcements near the top of the forum by coupon mad, complain about it to Sainsburys or the landowner , if necessary, to the head office ( John Lewis. ? )
Ignore ECP, IGNORE the powerless debt collectors letters too , especially DCBL
If necessary they will issue a court claim in the future, and then discontinue before the hearing fee is due , As usual

Well you don't need to correspond with debt collectors, and Euro know very well that their ANPR is fallible their ATA- The BPA has always acknowledged this and has stated in the joint COP:
7.3. Use of photographic evidence
NOTE 1: The manual quality control check for remote ANPR and CCTV systems is
particularly important for detecting issues such as “double dipping”, where image camera
systems might have failed to accurately record each instance when a vehicle enters and
leaves controlled land,So in effect if they wish to rely on ANPR images months after the event for evidence to state: "they delete any images within 14 days" is totally unacceptable, and I don't believe them what about all the other VRN's collected between that timespan have they been thrown in the recycle bin too? No it's convenient to lie to you for their own ends, I would have thought that admission might win at POPLA others may disagree.
As for evidence on the day do you have google maps on your mobile, if so look for your timeline for that date, it will show exactly your journeys for that day (IPhones have Maps visited places but it has to be switched on.
There is no reason to fear some two bit parking company with a camera on a pole, even authority ANPR systems which are regulated are only around 95-98% accurate, so an unregulated ANPR system run by any old dimwitted organisation like these has absolutely no chance of even hitting that mark.

They are lying to you:
- They MUST consider complaints and
- the DVLA KADOE rules state that the originating parking firm remains the data controller (and creditor), regardless of farming the case out to a third party debt crawler, and
- The DUA Act 2025 gives you a legal right to object to data processed unfairly or wrongly as a result of Automated Decision-Making (which this was: unchecked AI ANPR data and an automated electronic DVLA request, with a (Unity5 enabled by software) NTK letter issued entirely automatically, with no human intervention).
Complain again pointing out the above.
Then complain to the ICO (Google it).
No checks & balances exist any more. The DUA Act 2025 has weakened consumer protection, IMHO, and is partly responsible for the increase we are seeing in ANPR error / double dip PCNs. @Nellymoser has recently started a thread collating well over 200 examples and counting. Many involve Euro Car Parks.
