First Parking PCN at Newborough National Nature Reserve

I have already contacted NRW (site owner) to request they cancel this.

But thought I would open a thread for progress for others to see how it goes…

Carpark has 30 minutes free. We were not parked for longer than 30 minutes.

The ANPR cameras are at a road entrance to the forest… it takes 7 minutes according to Google to get to the carpark from the ANPR cameras …but its closer to 10 as theres cyclists, traffic, waiting for passing, walkers, dogs etc plus MASSIVE speed bumps to slow you down that bit more(!).

I have asked NRW to instruct First Parking to cancel the PCN based on First Parking including travel time in the parking period.

Lets see how it goes….

Ignore it if the landowner won't cancel it but you could send a complaint (NOT APPEAL) to F1rst Parking, pointing out that:

The position of the ANPR camera is seven minutes out from the actual car park. 7 minutes is according to Google to get to the carpark from the ANPR cameras but in reality it's closer to 10 minutes to get anywhere near the parking bays, due to cyclists, traffic, waiting for passing walkers, dogs etc., plus MASSIVE speed bumps to slow you down. As such, the cameras breach the ICO Code of Practice for Surveillance Cameras and if they refuse to take this complaint seriously and move the camera position to the actual car park, you'll escalate the complaint to the BPA and to the ICO. To use cameras this way is plainly unfair data collection and breaches the DPA 2018 and you will ask the ICO to investigate.

Hey! You've replied to my other long thread with great info, so thanks again for taking the time here.

I have complained to landowner, and they have said the same as when I complained to the landowner at a service station; 'nothing to do with us. we cant cancel it etc'

I will try a complaint to F1rst Parking.

Yep, you will end up escalating the complaint to the BPA and certainly to the ICO in the end.

But to do that, you must exhaust F1rst's own complaints policy first.

Show us the Google aerial view of that approach road, and please mark where the car park spaces are and where the ANPR cameras are.

How come there's only 30 minutes free? Is it a tariff after that?

No you could email their DPO, which is stated on their privacy page. As this complaint is about abuse of data and wrongful use of surveillance cameras in the wrong place, that's a DPA matter.

Sorry to be dumb dumb, Data Protection Officer? and Data Protection Act?

on their privacy policy page, there isnt any email address to use… says this:

"If you have any questions about this Privacy Policy, the practices of this site, or your dealings with this site, please contact us at: First Parking LLP, 27 Old Gloucester Street. London, WC1N 3AX."

I dont mind so much, just annoying, as I will want to send it recorded

Basically in the UK everyone has to comply with the Data Protection Act 2018 and UK GDPR. Businesses which handle personal data have to have a Data Protection Officer and contact details need to be in the published privacy policy. They are able to give an address rather than an email but in essence it is up to the business to redirect DPA enquiries to the correct person no matter where and how they are received. I would suggest that you send your query to their complaints email for the attention of the Data Protection Officer and also send a letter to the address they give. Do not send it recorded delivery but rather obtain a proof of postage.

New parking terms including ANPR started here on 30th March accordingly signage and repeater signs must be installed to that effect according to the joint COP (Material Changes) for a period of 4 months whereby motorists should not be given PCN's. In addition the land owner and site management (who I believe ultimately is the Welsh Government; ANPR really?) admits that getting in and out of the car park can be a problem at peak times!

New parking system 

New parking machines have been installed. Parking charges apply every
day from 6am to 11:59pm. Enforcement of parking charges started on 30
March. You can pay by contactless at the machine in the car park (the
machine will not take cash), on the RingGo website or app, or by phoning
RingGo.

Visiting during spring and summer

This is a popular destination when the weather is good.

Car parks are often full from 11am to 3pm, especially on weekends and Bank Holidays.

Please:

• be prepared for traffic congestion on the road to the car park.
• respect the local community and environment.
• consider visiting at quieter times or visit one of the many other beaches and destinations on Anglesey.

Seems that F1rst are one of those PPCs who find it helpful (not) to the motorist, not to provide an email address, only a postal address as noted above. They also don't seem to have a DPO. I have searched my database of email addresses for DPOs and they do not feature. Maybe a complaint to the ICO is in order.

I'd also include in any correspondence the Chair of the Board of NRW and point them to their Terms of Reference:

It must establish an Audit and Risk Assurance Committee chaired by a non-executive member (but not the Chair) to provide it with independent advice. The Board is also expected to assure itself of the effectiveness of internal control and risk management systems.

This set up is a reputational risk so should have been through an oversight process by that committee.
