Hi yes I did ask them they said they would have to email what they had over and they did in the form of a proforma invoice which only had oil and filter change listed which isnt good enough for Peugeot as they require filters etc to be changed at 1 year and top up of all fluids etc also because the 2008 has the wet belt issue they are very specific on the oil to be used .. I even emailed the service place the invoice was for to ask if they had a check list of what they did they didnt respond ..
I am surprised by this forum as there usually on point for consumer rights etc and not one person picked seemed to be concerned that you have a legal right to return a car if you have had it less then 30 days if there is a fault or if you are lied to to stop you exercising your consumer rights under the 2015 act .. which they did when they said we couldnt reject the car for the safety recall and had to give them a chance to fix the issue which I am not obliged to do
we still have the car its parked up awaiting Blackhorse to assign someone to the case and investigate which they have 56 days to do the minor damage will be repaired via the insurance company they are already arranging this

I'm not sure what you are wanting to achieve from the forum other than agreeing with you as you already seem to know the legality of what has happened (even if that isn't fully correct)

I think the length and amount of irrelevant detail in your initial post may have added to the confusion, so there have been a lot of additional questions.
As far as I can see:
Aircon issue is fixable and irrelevant.
Finance 'issue' is irrelevant
Warranty issue is irrelevant
The only relevant fact here is that they sold you a car with an active safety recall. You know the rules here so don't seem to need any advice on that front.
If not already done, you need to formally reject the car in writing and return it to the dealer ASAP. Make sure you keep the finance company informed too.
The accident complicates things, but that will need to be discussed between yourself and the dealer - it doesn't change anything with regards to the rejection.

Or just book the car in with a Peugeot dealer for the recall to be sorted FOC…0 -
1st year service is a minor one and the only crucial part of it is a change of oil and the filter. Fluids only need to be topped up if they actually need topping up which after 12 months may not be required. I think it highly unlikely the warrantee would have been invalidated.

Why do you think a car for sale outside the main dealer network should raise eyebrows? It’s 16 months old, not 16 days.
I bought my car at 5 months old from Motorpoint. The difference between Motorpoint and the main dealer network was around £4000. The car was absolutely fine and had the balance of the manufacturer warranty.

Because the main reason 16mo cars go into supermarkets is simple… They aren't up to scratch for dealer retail.
One main reason for that is that their warranties haven't been kept up. As here.
Now, think about who's buying new cars and selling them at a year old… It's definitely not lease companies and the like. It's vanishingly rarely nice careful private owners. Mostly, it's day-hire rental companies.0
