Parking Fine - Mistaken Identity
Hi there,
Hope you're all coping in this heat!
I was just wondering if you could help.
My Mother-In-Law has been receiving letters from a Debt Recovery Agency for a parking fine that does not relate to her - however it is for someone with the same first name and last name. She has never been to this car park or even the town it is in.
Facts as I know them:
- My M-I-L received a letter stating 'Notice of Debt Recovery - Unpaid Parking Charge £170.00' - We previously wrote to you at a different address but did not receive a response. We therefore utilised a tracking service which indicated this is your current address'.
- My M-I-L contacted the DVLA who "checked [their] records and can confirm that [her] name and address is not recorded under the current or previous keeper details" for the vehicle. She then contacted the Debt collection agency who said that it was a hire van. She advised them that she had not hired this van and they said essentially they didn't care and that she had to pay it.
- My M-I-L asked the debt collection agency for evidence and all they have provided her with is the initial Parking Charge letter which shows it was sent to an address she has never lived at (about 80 miles from where she lives), with a photo of the hired van with its number plate .
Incidentally, I think I have found the person it relates to on Facebook - in that they have the same first and last name and live where the parking fine happened… but don't worry I won't contact them! My M-I-L has said she has had correspondence that she thinks might be for them for a few years now - so there must be a mismatch in a system somewhere?
Any help on what to do next would be much appreciated.
I initially thought contacting the hire car company but I assume they wouldn't be able to confirm the details because of GDPR? As she isn't the person they rented the van to?!
Thanks!

Which parking firm

Group Nexus and then DCBL

I would suggest that she emails the DPO at Group Nexus and complain that they are unlawfully using her data, stating that she has never hired or owned any van and they must cease and desist from contacting her about the matter
Otherwise she will claim for
or something similar mistaken identity, harassment and misuse of her data, and claim damages too

can you provide the location of the car park, if this is known?

Hello! Yes it says Aylesbury shopping park?

OK, so the recipient just sends a data abuse/error complaint to Group Nexus' DPO email immediately. No template, just send what she has, use the words from @Gr1pr and call it out as a 'mistrace'.
Send the same to the DPO at DCB Ltd and threaten to report them to the CSA and to the ICO for refusing to listen to her data concerns & pursuing the wrong person due to a 'mistrace'. Require that her data is erased completely and an apology is sent.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

You should also lean very heavily on the reail park, it is they who have allowed an un regulated parking company onto their site
Running on the assumption the place is here :
https://aylesburyshoppingpark.com/
and a complaint here : as they will be jointly and severally liable for the actions of their agents

Hi all!
Here's an update - Nexus just replied to say "We were provided your details by the Registered Keeper who advised that you were in possession of the vehicle on the date in questions." So they've ignored everything we've said.
I was thinking of doing a SAR - or do I just forward it to the ICO and say that I believe they are holding my mother in law's information when they shouldn't be?
Thanks!
