Hi all

I have gone over the NTK and they have failed to Statutory Wording Requirement (POFA2012)

"They have failed to Identify the creditor"

If anyone can just confirm or not would be much appreciated...

Still going with plan A first this is just a back up to go down if needed.

I might just start looking into this industry 🤔 and start getting a better understanding so can help out others later, and hopefully the new parking code will come into force...but won't hold by breath..

Have found that the NTK failed under

Paragraph 9(2)(h) of Schedule 4 explicitly states that the notice must identify the creditor.

It just shows that you need to look at the notice carefully ... and assistance from the vast knowledge on here...

Plan A sent today to the head of operations of the land owners Crown Estate & CC in the general enquiry email as well...

Will keep posted of outcome.

Really minor. Judges won't consider that an omission. Don't go down AI rabbit-holes.

I have been in contact with the land owner and they have forwarded this to their agents.

The agents have been very helpful and replied quickly, but they would like me to go through Group Nexus appeals first with the same information first and proof of receipts.

They state:-

"They have a clear directive with the provider that if a customer appealed a parking charge notice showing evidence that they were a genuine shopper through receipts etc then any such appeal should be looked up on favourably"

They also they want to understand if this is working or not so can address bad practices by the provider.

If unsuccessful they will happily intervene...Have anyone come across this before?

I know there's a high chance that the appeal will be rejected, but I did state on the appeal that have been in contact with the land owners & their property agents and submitting this on their request first...see what happens.…

Hi All

Just a update that the appeal that I sent to Group Nexus was successful and the charge has been cancelled.

I sent the exactly the same letter and proof (cafe & shop receipts) that was sent to the land owner head of operations & was passed on to Saville who manages the site.

Saville were really good and wanted to know that their directives for the parking operator was being followed, that's why wanted me to appeal through their own appeal system.

I wonder if that I had not gone through the land owner (Crown Estate) & (Saville) that they were watching this, it would have been cancelled? 🤔

So for anyone with problems with Parking at "Gateway shopping centre Banbury" and was a genuine shopping have proof used the many facilities beforehand contact the:- enquiries@thecrownestate.co.uk DO NOT appeal directly to the parking operator first.
