The car is a second hand Audi Q7 and we are with Hastings insurance.
The only reason we was going to claim through the insurance was because the whole rejection process is taking to long and we are in need of a car.
We don’t have GAP insurance.The car is being held at a salvage yard through the insurance.

You've got the claim underway, so a stopgap rental should be part of that.
What have they offered so far, vs what you paid? That SHOULD be a straightforward one to argue, given the timescale.
And… how old a Q7 are we talking about? They were launched 20 years ago. Obviously, the situation is going to be VERY different for a 20yo £2k car vs a 12mo £95k one…1 -
I suspect the OP needs to exercise his short term right to reject under the CRA in order to get a full refund and not to lose any money.
He's quite probably paid more for it than the insurance value and he doesn;t have gap insurance.
I find it difficult to believe that a car that is not faulty would just burst into flames two days after purchase.
I wonder how difficult a court would find it to believe… ("res ipsa loquitur")

We haven’t been offered anything yet as the insurance have said they can’t go through with the claim until the car has had a forensic investigation which needs to be done through the dealership and finance company.
The car is 9 years old and was £18,000.
It just feels like we’re going round in circles and getting absolutely nowhere.

I would imagine your insurer has fire investigators they use. Could you ask them to recommend one?
Then you can use your insurer's investigator to write the report which will find the cause was pre-existing and your short-term rejection will be accepted.
Or, if the fault wasn't pre-existing, your insurer will pay out.

If your insurers want a forensic report then they should be commissioning one, it's different with the finance company.
Things are different however if they have rejected your claim and you are trying to overturn the decision but you havent said they have refused the claim… if they have then you need to say on what grounds.

I have no idea what this has to do with the finance company. Go to your insurance company and make a claim. Reports/Investigation/Assessments are all things they should be dealing with. Rejecting a car because it caught fire is going to be an instant fail, you have no idea why/what happened.

Normaly the fire brigade would provide what they believed was the cause of the fire.

There's no duty for your insurer to provide you with a courtesy vehicle unless you opted for that as an extra.
If you're claiming from your insurer, it's a straight forward total loss claim due to fire. I'm not sure why they want the selling dealer to conduct an investigation. It's down to the insurer the conduct the investigation.

Its pretty clear, the insurer doesn't want to pay up for a total loss. If there's a sniff that its the dealer's fault, they want that fully researched before paying anything out.
