Hi all

I received a PCN from these jokers which was issued very late and without photos of any signage. I appealed as below:

Re: Parking Charge Notice number: 703515 42 I dispute your 'parking charge' as the keeper of the vehicle. I deny any liability or contractual agreement, and there will be no admission as to who was driving and no assumptions can be drawn. Your Parking Charge Notice does not include a close-up photograph of the sign you contend was at the location and fully legible on the material date. The Parking Charge Notice was issued on 24th April 2026 - 21 days after the material date. Further, the Parking Charge Notice was not received at my address until 5th May 2026 - 32 days after the material date.. The Protection of Freedoms Act 2012 requires notices to be sent within 14 days of the parking event. This notice does not comply with the legal requirements and should be cancelled

They have rejected my appeal and demanded payment or further appeal to IAS. Having read through this forum I see that IAS are considered biased and not worth appealing to. Am I right in thinking I should just hold tight and ignore everything until this get to "Letter Before Action" stage, especially as the charge was issued so late after the event and without all supporting evidence - i.e. signage?

Yes, correct

But bear in mind that if they failed to comply with Pofa2012 it doesn't stop them chasing you because they also had the fallback position of 6 months to obtain keeper details and one month to get the pcn to the keeper , making 7 months. ( Pofa2012 isn't mandatory. )

As it is a non-POFA NTK then you could try IAS to see if UKCPM offer no contest. It doesn't cost you anything.

@cooldude255220 might stop by this thread to write you some wording if you show us both sides of the NTK.

Thanks. NTK attached. CPMUK has rejected my appeal. I would add that I do have a blue badge which is why I parked in the space, for 23 minutes. I realise this was a mistake but I could not see a sign and they've not provided evidence of one being visible or legible. They have now sent a "Final Chance Letter" threatening bailiff visits. Any further advice please?

They are NOT threatening bailiff visits!

Ignore them as you are too late to appeal and it's a non-POFA case, due to exceeding the 14 day limit to serve the first notice.

Supposedly posted 24th April but received 5th May suggests they used 2nd class post AND that it wasn't posted when they said it was!

Yes…

• unless I'm wrong and the appeal rejection was recent/June? In which case try IAS for the LOLs and to cost them money and
• unless your first appeal blabbed about being the driver?

That's not the NTK.

Show it please, both sides, with data redacted. And tell us when UKCPM rejected the appeal and did you admit to parking?

No I didn't admit to parking - my appeal to CPM rejected by them on 10/06 which gives me until 8th July to appeal to IAS. I have attached the original, redacted notice. Sorry, I'm a bit of a newbie and I appreciate all advise.

So looks like my next step is to appeal to IAS.

Yep clearly non-POFA worded (driver liability only) which even a complete newbie could spot at forty paces, going by that last paragraph on page one!

@cooldude255220 might be able to fo a quick IAS appeal point about that for you.

Please read through it and make sure you're happy with it, and put the PCN # in the bit in orange. Upload the appeal doc and all the appendices when you appeal.

Regarding appealing to the IAS: They are not independent. They are not fair. So don't expect to win.

But, I personally think it is nevertheless worth appealing to them:

1. According to the latest figures, ~ 25% of appeals are conceded by the operator. May as well see if you're in that lucky quarter.
2. If you're not that lucky, there's teeny tiny chance the IAS might actually allow the appeal.
3. Win or lose, you've still cost the Operator a bit of money because they have to pay for every adjudicated decision.
4. I want to see if there's any reasoning with the IAS, so the appeal I've put together is designed to give them nowhere to wiggle. It's a relatively new appeal and we've not seen them adjudicate on it yet.

Of course, the important thing is that you don't flap if and when they refuse the appeal! IAS decisions are not binding on the motorist.
