Letter of Claim - final notice before legal action escalation
Hi everyone,
The parking ticket was issued when I was attending my GP surgery. At the time, I contacted the GP and they sent me a message confirming that I was parked there legitimately and that I should not need to pay the parking charge.
I forwarded this information to the parking company, but they later responded saying that I had provided the information too late and that they would not cancel the charge.
I've now received a Letter of Claim / Final Notice Before Legal Escalation, and I've been told I have until 27 June to respond before they may begin legal action.
Has anyone dealt with a similar situation? Does the GP's message confirming I was entitled to park there help my case, even if the parking company says it was submitted late? Should I respond to the Letter of Claim myself, contact the GP again for further support, or seek legal advice?
Any guidance on the best way to proceed would be greatly appreciated.
Thank you.

There are quite a few like this case on here, so
Name the private parking company claimant involved
Name any lawyers involved too
Name the location of the surgery involved
Look at the 2nd post in the newbies sticky thread in announcements near the top of the forum by coupon mad
Especially read the responding to an LoC section and follow the advice there, using email
COMPLAIN strongly about it to the practice manager of the surgery , plan A in the newbies sticky thread in announcements near the top of the forum
Study the Yarm surgery saga too
Study half a dozen surgery cases or similar on here over the last 12 months or so
Ignore debt recovery letters, regardless of who sent them
Only respond to lawyers, or the CNBC in Northampton using MCOL

UK Car Park Management Limited is the car parking firm
bwlegal is who i have been getting letters from
The practice manager seems to just say they don't look after the car park so they can't do anything about it, maybe I am not pushing hard enough and using the emails on this forum to do so.
Should i fill in the return form?
Thank you very much for the help! I am currently looking into what you mentioned!

Thank you! I will use this if it comes to iy/ when the entire process is over. The manager seems to think they can't do anything as the carpark has been run by CPM

You dont return any forms
If the B W LEGAL letter gave you 30 days notice, you could either email the LoC template response in the 2nd post in the newbies sticky thread in announcements near the top of the forum
Or
Ignore them and wait for an N1SDT court claim pack from the CNBC in Northampton using MCOL to arrive in the post in the future

BW Legal are unlikely to know that the surgery have cancelled the charge.
Personally I would just email BW what you sent Premier and threaten to counterclaim if they are daft enough to take this case to court.

Hi again, I sent in an email to CPM UK company and they said they cant deal with it at this late date and to contact BW legal (which I already have done to no help). I also called the GP who stated the same. I can't seem to find the email you mention in the sticky thread, is there anyway you could send the link please? Thank you again for the help!

Is this an okay letter to resend to BW legal?
Dear BW Legal,
I dispute the debt in its entirety.
The vehicle was parked at the GP surgery while I attended a genuine medical appointment. I have attached written confirmation from the GP surgery confirming my attendance at the relevant date and time.
Your client's claim is unreasonable because the purpose of the parking restrictions is to prevent unauthorised parking, whereas I was an authorised user of the surgery facilities.
I request that the matter be placed on hold while my evidence is reviewed by your client and while alternative dispute resolution is considered.
Should proceedings nevertheless be issued, I will rely on the attached evidence and your refusal to properly consider it when the court considers the parties' conduct.
Please confirm receipt.
Yours faithfully,
xxxxxxxx0 -
The GP has also said they cannot get involved
