Flight delay - mixed reasons
Hello,
Recently had a flight delay (landed 3 hours 7 minutes late)
Airline (TUI) has rejected a claim as they say there were a number of reasons, one of which was an unruly passenger denied boarding.
Flight was delayed as plane was in Gatwick. Departure airport was Manchester so we were already told it would be departing 2 hours 45 minutes late.
Captain apologised for the delay and said it was due to the plane being used at Gatwick the day before and having to get back to Manchester.
Question is- How is a delay viewed if more than one reason? As far as I can tell. IF there was an unruly passenger it was accounting for maybe 20 minutes of the delay.
Bulk of delay was due to the plane not being at the airport.
Any guidance would be appreciated.

20 minutes out of 3h7m would put it under three hours, though.

That's what I was unsure of. Google seemed to suggest the substantial delay was enough to cover it. Nothing to say they would've been able to get away any earlier without the supposed unruly passenger.

I think the airline would argue that a 20 min delay outside their control, that pushed them beyond the three hour mark, would mean you're not eligible for compensation but it's worth applying - they can only say no and you've not lost anything.
BA paid out compensation for us when a 2 hour technical delay (their fault) pushed us into a thunderstorm which delayed us by another 3 hours, but I was very surprised they did so without a fuss.

They have refused the claim based on the unruly passenger. No guarantees we would have got away any earlier without it as they were delayed anyway so likely to have missed slots

Unfortunately 'what ifs' don't count for much. If you arrived just over 3 hrs late, and the unruly passenger delay is what took you over the limit, I can see why they wouldnt pay out.
You can still appeal, but maybe don't expect too much.
