Out of hours fee for car hire after flight delay
My flight RK1394 developed a fault and ended up 2 1/2 hours late in Oslo (so it is below the threshold of UK261). As a result I missed the closing time (midnight, originally booked for 22:00) of the car rental (Sixt) and ended up with an out of hours fee of NOK 695.
Unfortunately the delay didn't meet the threshold (6 hours) of my travel insurance to pay out, and my travel insurance didn't have any terms to cover additional expenses after a flight delay.
Do I have any legal rights to recover this fee?

No ‘legal rights’.
Always a gamble when you book a flight with a late evening or night time arrival, to match into a car rental pick up with limited collection hours.

Thanks.
This is a Friday evening out trip and the car rental is already the latest one available there, closing at midnight with some others closing earlier.
For future reference, will I be protected if I book the flight and the car rental in a single transaction?

The fee was charged at the spot after I presented myself late at the car hire, and the official grace period was 1 hour from my booking time which I exceeded.
Does anyone know if my case is covered under the Article 19 of Montreal Convention? Are there any precedents?

Was the airline culpable for the fault which caused the flight delay ?
Or was it unforeseen adverse circumstances ?
If the latter I suspect Article 19 of the Montreal Convention may not apply ?

No.
The car hire companies have their own terms that aren't related to the flight.
Always make sure to attach your flight info to the booking so they are aware of the flight you are on. That is the only thing you can do.

The flight departed, the captain reported a problem and turned it back, then after checking we were sent onto a replacement aircraft

Yes, we do know.
No, you are not covered. As per the previous responses to your initial question which were succinctly answered.

When we had a late night arrival we booked our car hire for the next morning and stayed the night in a local hotel.

There is a need for new legislation to deal with "late collection" car hire terms.
