Overdue CCJ, £526.83 owed

Hi All,

On the 24th April I received a text message from Empira, stating that they had been instructed to enforce a judgement on me by Gladstone solicitors.

At first I thought “scam” but I rang them up anyway after which I stayed in a queue for 10 mins with no answer so I hang up. A month down the line I receive another text saying that there is now a CCJ . So I ran a search using “Trust Online” and it turns out there is , but the date of judgment was on January and it was on an address that I haven’t lived in for over 3 years.

For context, I was a student, and that was my first address that I lived at, every year I changed Addresses, and with ever change I updated my VC5, I have all the documents.

I never received any letters whatsoever during my stays at the other addresses.

My question is, what do I do now?

Empira are connected to Gladstones.

Assuming you will need credit within the next 6 years, you should do a CCJ set aside application to wipe it.

DO NOT PAY IT.

See post 2 of the NEWBIES thread for advice about that. As they failed to bother to do a soft trace to find you before litigation, you can also claim back your £313 fee against the Claimant at your hearing but you must ask/insist. Some judges get that wrong.

However, the set aside of the CCJ is mandatory. Even a rookie/grumpy Judge has no choice - no discretion - due to CPR 13.2 and the binding authority of VCS v Carr. The CCJ must be set aside.

No.

They are connected to Gladstones and won't agree to set aside and will try to bully you into paying. Which DOESN'T wipe a CCJ.

i have no clue. I’ve received 0 communication even regarding what exactly the charge is for, I dont know if its PCN ir something else. Even though im 99% sure it is for a PCN, as there is nothing else it could be for.

HI,

So I checked on my Experian but nothing appeared there but it was on the Credit Karma report. I also called the court to get more information on the case, which they sent over via email. Its to do with a PCN on July 2023 by UKPC, 1 month after that I changed the address on my VC5, which is the reason as to why I never received any letters I guess.

From what I have read so far from the thread, the best course of action is to send an email to the solicitors with a template similar to this one by @troublemaker22:

After which, I file for a N244 with a draft order and a witness statement.

Is there anything else you recommend to do?
