CEL in-house claim: hearing & WS help

Just received this.

Should we ignore, write back saying we reject, write back with counter offer? Would appreciate any advice. Claimant should have paid trial fee £27 by 14 July. Hearing is on 11 August. We submitted our Witness Statement. We did not receive any witness Statement from CEL.

You do need certainty about whether the hearing is vacated so email the local court and cc in CEL, asking if the hearing has been vacated because the Claimant has failed to comply with the hearing Order yet has not served a Notice of Discontinuance.

You need to delete that unredacted document, redact the claim reference number, pcn reference number and your name, then repost a picture of the redacted document

We sent an email to the County Court but received no reply. Yesterday we called them and they confirmed no payment has been made and no Witness Statement issued by the Claimant but the case is scheduled to go ahead. She advised us to email again marking it Urgent in the subject line, which we did yesterday. We did receive the attached letter. Not sure what it means. I would appreciate any guidance. The hearing is scheduled for next week (11 Aug).

Court sounds a bit dozy. They forgot to send you the dates the first time round. But nothing changes because CE have still missed all the deadlines. Probably because they're in Liverpool and have no intention of driving to London. They're using the time between missing the deadline and the hearing to pressure you into settling.

Assume it's going ahead on 11th because you haven't been told otherwise, but expect a Notice of Discontinuance any second.

Have you worked out a costs assessment?

You can go for costs by turning up on the day and asking to speak to the judge about unreasonable behaviour when you find out the listing has been vacated.

Or, if you can take heed of their discontinuance and write to the judge for costs.

Exchange Flags, Liverpool is nothing more than a Mail Drop. I couldn’t imagine any PPC physically basing themselves in Liverpool, with the inevitability of issuing a parking ticket to a Scouser! 😄
