APCOA fine MCR Airport drop off

Hi MSE crew

New to this and looking for advise with a APCOA PCN recieved £60 in 14days or £100 from date issued only recieved( not signed for )few days nearly week after that and i have been away so i guess £100 ..

I went over deadline to pay by few hrs once remembered .. IT LET ME PAY given it was day after event ..yet recieved PCN saying not valid payment notice to keeper stating private land on Manchester Airport ..

Can i ignore this or appeal on what grounds

No blabbing about who was driving or about what happened, no explanations, no fairy stories, just the template appeal

Thanks again foe advise please confirm that if i read the thread right and i copy and paste the following on their appeal site entering only PCN number and reg then this in appeal details ..

This is an appeal by the registered keeper - No driver details will be given. Please do not bother with your known fishing expedition in an attempt to get driver details to try and get around the fact there is no keeper liability (and never can be under POFA).

Due to this being airport land you will be well aware there is no keeper liability due to the byelaws in force and the fact this is not relevant land.

As there is no keeper liability then liability cannot flow from the driver to the keeper and thus is an auto win @ POPLA. Please therefore cancel the notice or issue a POPLA code where you will auto withdraw

If you waste your time asking for driver details this will be ignored and you will still lose at POPLA if you dont cancel the PCN

So let's save my time and yours and cancel this PCN you simply cannot win this (and you know it).

This is correct proccedure

Sorry for the repost on this matter but if i was enter this at appeal as its got more jargon 🌝 will this be suffcient and less abrupt not that it matters mind ..

I appeal as the Registeted keeper. I am not obliged to identify the driver and I decline to do so.

1. You are unable to transfer liability to the keeper pursuant to Schedule 4 to the Protection of Freedoms

Act 2012 ('POFA') because airport drop off zones are not ‘relevant land’ as defined in POFA.

2. Even if (which is not the case) the land in question is relevant land your notice does not conform to the

requirements set out in POFA paragraphs 9 (2) (f).

Furthermore, as keeper I am entitled to all the defences available to the driver including (without limitation)

the following:

3. The parking charge is not notified until after the contract is entered into and under the principles set out

by the Court of Appeal in Thornton v Shoe Lane Parking - 1971, does not form part of the contract between

the driver and APCOA

4. The signage is not compliant with the BPA Code of Practice

5. The car was present in the drop off zone for not more than 5 minutes and the driver is entitled to the 5

minute consideration period mandated by the BPA Code of Practice

Any one of the above reasons is alone sufficient to require cancellation of the PCN.

Therefore, I require you to cancel the PCN and expunge my personal data from your records....
