Oh wait - NPC are in the IPC so no POPLA.

Totally ignore them from now on unless you get a LBC or claim form, or of course if you move house you MUST tell them.

    Thst is all.

You already know from when you read post 3 of the NEWBIES thread that the IAS is a kangaroo court!

Unless @cooldude255220 can see a way to try an IAS appeal based on the date sent (non-POFA served) and NPC's refusal to comply with the Code of Practice and supply proof of postage on request (I think that's in the Code).

Going forward: stop using privately operated car parks wherever possible. Avoid.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks.. would be interested in @cooldude255220 input..

Unfortunately there is it not any choice of parking where the car was needed to park. Care work is being done for an individual next to to the car park and the duration of care is 3hrs. It happened to run over in this instance.

Can you upload a copy of the rear of the Notice?

This is another one which does not (as far as I can see) "state that the creditor does not know both the name of the driver and a current address for service for the driver".

Also, can you post a readable picture of the serial number in the bottom left of the notice?

@SatinTape I have put an appeal together (here) but this is on the basis that the Notice does not comply with the requirements of 9(2)(e) and 9(2)(f) of Schedule 4. You'd just need to put the notice number in.

In my opinion those are the best arguments.

If you want to include something about the dates, you can include the following paragraphs (numbered as such, so after the current paragraph 10, and before the current paragraph 11 (which would be renumbered to 16). However, it is going to be an uphill battle to convince the IAS that it took 12 days to arrive and I think it is better to stick to your best points. You don't want to look like you're just throwing rubbish and trying to see what sticks.

    11. In addition, paragraph 9(4) of Schedule 4 of POFA requires that, where the notice is sent by post, it is DELIVERED (not just sent) within the relevant period.

    12. Paragraph 9(5) of Schedule 4 of POFA provides that the relevant period for delivery is 14 days, beginning with the day after the parking event.

    13. The alleged parking event was 24th April 2026. Taking 25th April 2026 as the first day, that means 8th May 2026 is the 14th day - i.e. the last day on which the Notice could be DELIVERED and meet the requirement of Paragraph 9(4).

    14. The Notice was actually delivered on 12th May 2026 which is outside the permitted 14-day period for DELIVERY. I am prepared to give evidence on this point in court under oath and under penalty of perjury.

    15. The Single Sector Code of Practice states that “parking operators must retain a record of the date of posting of a notice” but no such evidence has been forthcoming from the operator.

@Coupon-mad NPC's PCN is listed as POFA Compliant in this thread but for the reasons above I don't think it is.

I think you are right, especially given that even the flagship firm ParkingEye were recently held by a judge to have a similar problem with their NTKs not 'inviting the keeper to pay'.

Now the above non-compliance is different from the ParkingEye case but either one of these omissions is every bit as valid.

Well worth an IAS appeal. As long as the OP knows not to pay, if they lose.
