National Parking Control - Parking Charge Notice
Hi All,
Apologies if there are very similar posts.
I received a parking charge notice yesterday in the post stating the driver of my vehicle had exceeded the 3hr free stay by ~33mins with photos of the car entering and exiting the car park (photos not parked)
The Date of posting on the letter is 30th April and the Date of the Parking event is 24th April.
I received this yesterday 12th May in an non date-stamped envelope with the Return address on it of PO BOX 61278 Garman Road, London N17 1DS. I have taken photos yesterday of the letter and the envelope. I have nothing to say though that the letter arrived yesterday other than my word for it and the timestamped photos i took yesterday
I gather from reading a bit on this forum that a possible cause of action would be to respond through the online appeals process as follows bearing in mind the late date of receiving the letter through the post
"I am the Registered Keeper. I have no liability in this matter as the Notice to Keeper was not served within the 14-day period required by Schedule 4 of the Protection of Freedoms Act 2012 While the letter is dated 30th April, it was not delivered to my address until 12th May. This exceeds the 14-day mandatory window from the date of the parking event (24th April). As POFA compliance has failed, you have no legal right to recover this charge from the keeper.
I am under no legal obligation to identify the driver and will not be doing so. I require you to cancel this notice and confirm you have removed my details from your system."
Can anyone confirm this is ok today before i put the appeal in later today online?
The date for when the proposed fine increases from £60 to £100 is tomorrow 14th May so doesn't give me long to respond.
with thanks

No the 14 day bribe is completely irrelevant! This is in the early FAQS in the NEWBIES thread.
You will NEVER have to pay this invoice so who cares about the discount bribe?!
Add to your appeal that you want a certificate/proof of posting attached to their reply, as required in the Code of Practice.
I think these proof of posting are being falsified (based on other cases we've seen) so I think we need to gather evidence of it.

ok thanks Coupon-mad. So you are suggesting they have to provide a proof date they posted it?
In terms of the appeal text am i ok to go with just the above?
I have pictures of the parking charge notice and envelope with their date stamps on them which can submit if National Parking Control reject my appeal and it goes to the IAS .

Perfect! It won't 'work' but the idea is to flush out the supposed proof of posting.

One final query at the moment.. just starting to fill in the appeal on the National Parking Control website.
The 'reasons' are in the attached jpg. None of them seem to be correct . I was going to choose i did not receive the parking notice by post option ..
i think this is a mandatory field.. but would welcome your thoughts on the reason to select..
unless thats just BS as well and it doesn't matter what i select !

Nothing that says I
Try Submitting it without the field selection
If that fails, choose the signage option

Thanks !
I have submitted it without choosing a reason and it accepted it . So it wasn't a mandatory field… so even their website is a piece of sh1te .. the * counting for nothing
