Smart Parking via DCL Legal Claim
Hi All,
Thank you for all of your advice on this subject, it has helped a great deal. I have received a claim form / threat of CCJ for a parking fine in July 2022. I have submitted AOS and about to submit defence via MCOL. Do I tick yes or no for making a counterclaim? (I have said I defend ALL of the claim). Also, do I still need to email the defence to the advised email address, or just upload to MCOL?
Thanks in advance

Follow the advice in the following thread
Copy and paste into the defence box on MCOL, save, submit
No paperwork, no uploads, no emails either, only MCOL
No counterclaim, but defend ALL is correct

All this information is in the NEWBIE sticky; however, tick NO for counterclaim, do NOT send the defence by email but submit via MCOL using the template defence. If this relates to your other open thread, that is the place to continue with it; if this is a new issue, some more detail would be great.

You will be using the bespoke Smart Parking defence by @Meltof in the Smart Parking Defence Group Thread. Easy!
(But no, I won't link it. Hate doing that as newbies need to gain confidence with searching & using the forum).

Hi, update on this case. I am point of mediation which is supposed to be today between 09:30 - 12:30. I am planning to say "To save everyone's time, it's a £zero offer, please pass this onto the claimant". And also highlight to the mediator that DCBL have tried calling me twice a day for the past 6 weeks which I am guessing was to settle out of court which is why I won't waste anymore time on the call as it will be discontinued before hearing. I have ignored all the calls so can't be sure, but reading other threads on here, I imagine that's what it is.
My question today is, if the mediator doesn't call in the allocated slot (I checked that I had provided my phone number on N180) should I email them for a new slot, or leave it to them to sort? I am just worried that if they call outside of planned time, I will miss the call as I have moved my whole working day around to be available for the call, and will be in back-to-back meetings for most of the day.
TIA

Doesn't matter if you miss it, so stop worrying ( and anyone can take the call, so take note. )

Had the call.
Mediator - sorry for the late call we were experiencing technical issues this morning, is now a good time?
Me - To be honest, all I have to say is that I am offering £zero and that concludes the call. I have had numerous calls from DCBL wanting to settle the case outside court, so I imagine it will be dropped before it gets to the hearing
Mediatior - no problem, you will receive an email confirming it is unsettled
Me - ok thanks, have a lovely day!
Bring on the N279 :) Fingers Crossed3
