Hi all,

Firstly thank you so much for spelling out the process.

I've received a letter of claim

I've applied for AOS and am about to submit my response but wanted to check point 3. For context, I wasn't driving the privately leased vehicle, my wife didn't see the signage. All correspondence has been ignored until this point.

"2. The allegation(s) are vague and liability is denied for the sum claimed, or at all. The delay in bringing proceedings lies with the Claimant, making retrieving material evidence difficult, which is highly prejudicial. The Defendant has little knowledge of events, save as set out below and to admit that they were the lessee and driver.

3. The allegation is said to have occurred on a date 4 years ago. The defendant cannot recall who was driving the privately leased vehicle on that day."

It feels like a repeat of point 2. Also I've checked Google Maps and signage looks insufficient and there's very little/no lighting on any signs. Not sure if I should put this in point 3?

Leave paragraph 2 as is for now apart from deleting the word Registered, especially because Smart Parking never comply with Pofa2012 regarding lease cars

If the date of issue is 04 May - it is a bit blurred

With an issue date of 04/05/26 and providing you complete(d) the AoS after 09/05/26 and before or on 23/05/26 your defence deadline date is 4.00 p.m. on 08/06/26

OK, academic then but the deadline, which you have beaten, would have been 8th June.
