Smart Parking Ltd Para 3
Hi all, ive received a letter from HM Court, from smart parking limited (through i think its dbt law, sorry just from memory) ive read through all the forums posts and bits a pieces and was just looking if I could have some pointers if my paragraph 3 is adequate or if there is room for improvement and things to remove prior to submitting it on MCOL. I do understand this happens often but ive copied the template, added paragraph 4 and was just looking for guidance so I do apologise as I know the forum reduces large volumes in regards to smart parking
" 3.Referring to the Particulars of Claim, paragraph 1 is denied. The Defendant is not indebted to the Claimant. Although the Defendant is the registered keeper, paragraphs 3 and 4 are denied. The Defendant is not liable and has been provided with no evidence of any breach of clear or prominent terms. The Defendant denies the claim in its entirety. Any stay at Haven Banks retail park was either within paid time or covered by a reasonable extension, including mandatory grace periods under the relevant Code of Practice. Given the passage of more than three years and the lack of detail in the inadequate Particulars of Claim, it is impossible for the Defendant to provide a full response, additonally to this the only letter recieved was in 04/23 which the Defendant appealed and did not recieve a response, with no further letters received, The claimed sum is grossly inflated, as no private parking charge can lawfully amount to £160, and no loss or damages were incurred. "
Ive already followed the first few steps and have extended the time for my defence and am attempting to follow the guide best I can, cheers

Yes it was 2022, I never received a letter until I got a letter from a debt collection solictor about 6 or 7 months later, cant remember it exactly, and in the meantime ive moved address (updated all my details with DVLA) and never heard anything else until now.
However some advice i could really use, I am moving to a new address within the next 2 months, what measures should I take to ensure future correspondence goes to the new address?

You would edit your details on MCOL
You would inform dcb legal using their info@ email address
You should put mail redirection in place in due course

Thank you, and I found the 12th of april defence template as i believe you mentioned in that thread, I will admit that initially this site is overwhelming trying to wrap my head around multiple examples, though I am getting more familiar

Then study the first post in the defence template thread in announcements near the top of the forum
Especially Study the 8 steps, because you are not halfway through yet
Lastly, study the 2nd post in the newbies sticky thread in announcements too

- Just get the defence by @Meltof copied & pasted in on MCOL and submit it.
- Check MCOL weekly to see when your DQ is posted out to you, then follow the 8 steps, which mainly involves twiddling your thumbs!
